{"data":{"id":"us-ky/krs-199.801","jurisdiction":"us-ky","citation":"KRS 199.801","heading":"Procedure for placement of children who are in custody of department --","body":"State-level and regional placement coordinators -- Type of placement -- Cases\nof unmet need -- Recruitment and reporting.\n(1) The department shall establish a procedu re throughout the state that is designed to\ndetermine and expedite the placement of children who are in the custody of or\ncommitted to the department. The procedure shall utilize state -level and regional\nplacement coordinators who may be state employees or  employees of a contracted\nentity.\n(2) The type of placement selected for a child in the custody of or committed to the\ndepartment shall be the best alternative for the child that is in closest proximity to\nthe child's home county, including considerations  of the child's current early care\nand education provider or school, in order to promote educational stability for the\nchild to the extent practicable in accordance with KRS 199.802 and the federal\nEvery Student Succeeds Act of 2015, Pub. L. No. 114-95.\n(3) If the type of placement that best suits the child's needs is not available in the child's\nhome county, the regional placement coordinator shall document the circumstance\nas an unmet need and may seek a placement in surrounding counties, regions, and\nthe state, in that order.\n(4) If the type of placement that best suits the child's needs is not available within the\nstate, the regional placement coordinator shall contact the commissioner of the\ndepartment or the commissioner's designee to explore out-of-state placement.\n(5) The department shall develop a diligent recruitment plan and reporting to support\nthe recruitment and retention of family foster homes that are responsive to the needs\nof children in care, areas of unmet need, and strategies to meet the need. The plan\nand reporting shall be used as a guide in the establishment and modification of\nagreements with placements for the care of children in the custody of or committed\nto the cabinet and shall be made available upon request.\n(6) The department shall ensure that placement provisions exist to ensure that:\n(a) Safe and adequate foster care placements designed to meet the individual\nneeds of all children, including in prevention, safety, ongoing, and adoptive\nservices are occurring; and\n(b) Placements are the least restrictive, most family -like setting consistent with\nthe child's specific individual needs.","path":["KRS Chapter 199"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57452","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:54Z","sha256":"efb232702e5458d2d1d0354993bf791c708213b16b11055e7a92bd43b3ce4262","source_id":"us-ky","stale":false,"prev":"us-ky/krs-199.800","next":"us-ky/krs-199.802"},"notice":"GroundRules: Original legal text.
