{"data":{"id":"us-ky/krs-199.884","jurisdiction":"us-ky","citation":"KRS 199.884","heading":"Administrative regulations.","body":"The  cabinet, or its designated department, shall promulgate administrative\nregulations in accordance with KRS  Chapter 13A to effectuate the provisions of KRS\n199.881 to 199.888, including:\n(1) Creating a standardized agreement for employers, employees, and providers\nwishing to participate in the program, to be completed and agreed to by each\nrespective party that includes:\n(a) Name,  physical location, size, and industry of the employer;\n(b) Name  and phone number of the employer's point of contact;\n(c) Name  and physical location of the child-care provider;\n(d) Name  and phone number of the child-care provider's point of contact;\n(e) Name  and home address of the employee;\n(f) Total contribution to be paid by the employer to the provider, either\ndirectly or through a third-party vendor;\n(g) Total amount of the state match to be paid to the provider, either directly\nor through a third-party vendor;\n(h) Duration of the contract, which shall not last beyond the end of the state's\nfiscal year in any given year;\n(i) Frequency  of the contribution to be made  directly to the child-care\nprovider in accordance with the provider's established billing cycle; and\n(j) Demographic information of the employee;\n(2) Establishing eligibility verification procedures for the following parties as a\nprerequisite for the cabinet entering the agreement as a party and issuing a\nstate match:\n(a) Employer's enrollment in the program;\n(b) Employee's eligibility; and\n(c) Child-care provider's eligibility;\n(3) Collecting and verifying household income information from eligible employees\nand  determining the amount of the state match for which the employee is\neligible in accordance with KRS 199.885;\n(4) Creating procedures for issuing a notice to all parties to the agreement of their\nenrollment in the program upon receiving and processing the contract and\ndetermining eligibility;\n(5) Compiling  confidentiality protocols for the cabinet and  its designated\ndepartment  or departments to safeguard the personal information of\nparticipating employees, employers, and child-care providers;\n(6) Introducing reporting requirements for an employer or a child-care provider\nreporting a lapse or nonpayment  of contribution towards eligible child-care\nservices;\n(7) Creating procedures for issuing and logging a state match to child-care\nproviders pursuant to the respective contract;\n(8) Maintaining records of the fund in the fiscal year and all payments;\n(9) Creating criteria for participant disqualification from the program;\n(10) Establishing procedures for appeals hearings; and\n(11) Establishing procedures for recouping state matches or portions of state\nmatches that result in overpayments to participating child-care providers.","path":["KRS Chapter 199"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52172","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:55Z","sha256":"9f7ca8f029eeeef4b76c65c791cc149c0e970e2fc785877d615142752bdddba0","source_id":"us-ky","stale":false,"prev":"us-ky/krs-199.883","next":"us-ky/krs-199.885"},"notice":"GroundRules: Original legal text.
