{"data":{"id":"us-ky/krs-199.885","jurisdiction":"us-ky","citation":"KRS 199.885","heading":"Employee Child Care Assistance Partnership fund.","body":"(1) There is hereby established in the State Treasury a revolving account to be known\nas the Employee Child Care Assistance Partnership fund. The fund shall consist of\nmoneys appropriated by the General Assembly, contributions, gifts, or grants made\navailable for the purposes of the program.\n(2) The fund shall be administered by the cabinet or its designated department.\n(3) Notwithstanding KRS 45.229, any moneys remaining in the fund at the close of the\nfiscal year shall not lapse but shall be carried forward to the next fiscal year.\n(4) Any interest earnings of the fund shall become a part of the fund and shall not\nlapse.\n(5) Moneys deposited in the fund are hereby appropriated for the purposes set forth in\nKRS 199.881 to 199.888 and shall not be appropriated or transferred by the General\nAssembly for any other purpose.\n(6) A third-party administrator shall issue state matches out of the fund to child -care\nproviders in accordance with the provisions of the respective contracts and in the\norder that the cabinet processed the contracts.\n(7) (a) The state match shall not exceed one hundred percent (100%) of the\ncontribution made by the employer for contracts in which the employee's\nhousehold income is equal to or less than one hundred percent (100%) of the\nstate median household income.\n(b) The state match shall decrease by ten percent (10%) for each twenty percent\n(20%) increase in household income over one hundred percent (100%) of the\nstate median household income up to one hundred eighty percent (180%) of\nthe state median household income.\n(c) The state match shall equal fifty percent (50%) for contracts in which the\nemployee's household income exceeds one hundred eighty percent (180%) of\nthe state median household income.\n(8) In each fiscal year, twenty -five percent (25%) of the total fund shal l be distributed\nto agreements in which an employer is a small business.\n(9) In fiscal year 2022 -2023, five percent (5%) of the total fund shall be distributed to\nthe cabinet to administer the program. Beginning in fiscal year 2026 -2027 and in\nevery fiscal  year thereafter, up to ten percent (10%) of the total fund shall be\ndistributed to the cabinet for administrative purposes related to the program.\n(10) A state match issued pursuant to this program and administered by a third -party\nadministrator is for the promotion of the general welfare and shall not be considered\ncompensation for an employee's service.","path":["KRS Chapter 199"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56909","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:55Z","sha256":"b46960436364205808b5628ed7fe8384f92681ad2e02ff4b392bd31837903cc5","source_id":"us-ky","stale":false,"prev":"us-ky/krs-199.884","next":"us-ky/krs-199.886"},"notice":"GroundRules: Original legal text.
