{"data":{"id":"us-ky/krs-199.886","jurisdiction":"us-ky","citation":"KRS 199.886","heading":"Participation by employer and employee -- Contract -- Payment for costs","body":"of service.\n(1) If an employer wishes to provide child -care assistance to an employee as a benefit\nof employment and participate in this program, the employer may enter into an\nagreement with its employee and a child -care provider using the standardized\ncontract provided by a third-party administrator.\n(2) To participate in the program, an employer shall do the following:\n(a) Access the standardized contract created by the cab inet and enter into it with\nthe employee and child-care provider;\n(b) Submit the proposed contract to the third-party administrator; and\n(c) Submit any additional information as deemed necessary by the third -party\nadministrator pursuant to KRS 199.884.\n(3) (a) The employer shall submit its contributions for each contract under this\nprogram to the third -party administrator, either in lump -sum payments or in\naccordance with the amount and frequency agreed to in the final contract. The\nthird-party administrator shall distribute the contributions from the employer\nto the child-care provider along with the state match in a timely manner and in\naccordance with the contract. In the event that a contract is terminated early,\nfor any reason, the third -party administrator shall remit any remaining funds\ncontributed by the employer for the particular contract back to the employer.\n(b) If requested by the employer and approved by the third -party administrator\nand the child -care provider, employers shall have the ability to make\ncontributions directly to child-care providers.\n(c) All payments to child -care providers shall be made in a timely manner in\naccordance with each contract's individual stipulations.\n(4) To participate in the program, an employee shall complete the standardized contract\nwith the employer and the child -care provider and provide any additional\ninformation as deemed necessary by the cabinet pursuant to KRS 199.884.\n(5) In the event that the a greement includes costs of service not covered by the\nemployer's contribution and the state match, the employee shall make payments to\nthe child-care provider according to the amount and frequency determined by the\nfinal contract. If another member of the employee's household or family becomes a\nparty to an agreement in accordance with KRS 199.881 to 199.888, the employer\ncontribution and state match of that agreement may be utilized to pay for costs of\nservice not covered by the employer contribution and s tate match of the preceding\nagreement, provided that it does not result in overpayment to the provider.","path":["KRS Chapter 199"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56910","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:55Z","sha256":"479f0803b0a87dcf06ae311e081d1fe11e0249a616a3167bb84090f98300ede6","source_id":"us-ky","stale":false,"prev":"us-ky/krs-199.885","next":"us-ky/krs-199.887"},"notice":"GroundRules: Original legal text.
