{"data":{"id":"us-ky/krs-199.8943","jurisdiction":"us-ky","citation":"KRS 199.8943","heading":"Quality-based graduated early care and education program rating system","body":"-- Administrative regulations.\n(1) As used in this section:\n(a) \"Federally funded time -limited employee\" has the same meaning as in KRS\n18A.005;\n(b) \"Primary school program\" has the same meaning as in KRS 158.031(1); and\n(c) \"Public-funded\" means a program which receives local, state, or federal\nfunding.\n(2) The Early Childhood Advisory Council shall, in consultation with early care and\neducation providers, the Cabinet for  Health and Family Services, and others,\nincluding but not limited to child -care resource and referral agencies and family\nresource centers, Head Start agencies, and the Kentucky Department of Education,\ndevelop a quality -based graduated early care and edu cation program rating system\nfor public-funded licensed child-care and certified family child -care homes, public-\nfunded preschool, and Head Start, based on but not limited to:\n(a) Classroom and instructional quality;\n(b) Administrative and leadership practices;\n(c) Staff qualifications and professional development; and\n(d) Family and community engagement.\n(3) (a) The Cabinet for Health and Family Services shall, in consultation with the\nEarly Childhood Advisory Council, promulgate administrative regulations  in\naccordance with KRS Chapter 13A to implement the quality -based graduated\nearly childhood rating system for public -funded child -care and certified\nfamily child-care homes developed under subsection (2) of this section.\n(b) The Kentucky Department of Education shall, in consultation with the Early\nChildhood Advisory Council, promulgate administrative regulations in\naccordance with KRS Chapter 13A to implement the quality -based graduated\nearly childhood rating system, develope d under subsection (2) of this section,\nfor public-funded preschool.\n(c) The administrative regulations promulgated in accordance with paragraphs (a)\nand (b) of this subsection shall include:\n1. Agency time frames of reviews for rating;\n2. An appellate process under KRS Chapter 13B; and\n3. The ability of providers to request reevaluation for rating.\n(4) The quality-based early childhood rating system shall not be used for enforcement\nof compliance or in any punitive manner.\n(5) The Early Childhood Advisory Council, in consultation with the Kentucky Center\nfor Education and Workforce Statistics, the Kentucky Department of Education,\nand the Cabinet for Health and Family Services, shall report by October 1 of each\nyear to the Interim Joint Committee on Educati on on the implementation of the\nquality-based graduated early childhood rating system. The report shall include the\nfollowing quantitative performance measures as data becomes available:\n(a) Program participation in the rating system;\n(b) Ratings of programs by program type;\n(c) Changes in student school-readiness measures;\n(d) Longitudinal student cohort performance data tracked through student\ncompletion of the primary school program; and\n(e) Long-term viability recommendations for sustainability at the e nd of the Race\nto the Top-Early Learning Challenge grant.\n(6) By November 1, 2017, the Early Childhood Advisory Council and the Cabinet for\nHealth and Family Services shall report on recommendations and plans for\nsustaining program quality after the deplet ion of federal Race to the Top -Early\nLearning Challenge grant funds.\n(7) Any federally funded time -limited employee personnel positions created as a result\nof the federal Race to the Top -Early Learning Challenge grant shall be eliminated\nupon depletion of the grant funds.","path":["KRS Chapter 199"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53682","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:55Z","sha256":"56742d6ae1cc062678c9acb1d4731b94b410dbe12098a245647a3116e97773e8","source_id":"us-ky","stale":false,"prev":"us-ky/krs-199.8941","next":"us-ky/krs-199.8944"},"notice":"GroundRules: Original legal text.
