{"data":{"id":"us-ky/krs-200.509","jurisdiction":"us-ky","citation":"KRS 200.509","heading":"Regional interagency councils for the system of care in each area","body":"development district.\n(1) There are hereby created regional interagency councils for the system of care.\nThese councils shall be formed in each area development district with in the\nCommonwealth of Kentucky, except that those area development districts that\ncontain a county with a population greater than one hundred thousand (100,000)\nmay form up to three (3) such councils. The regional interagency councils shall be\nchaired by one (1) member, chosen by a majority vote of the members. Each\ncouncil shall be composed of the following members:\n(a) The children's services director from each regional community mental health\ncenter or his or her designee;\n(b) One (1) court -designated specialist or court -designated worker chosen by the\nexecutive officer of the Department of Family and Juvenile Services of the\nAdministrative Office of the Courts;\n(c) One (1) special education cooperative representative with behavioral health\nexperience chosen by the directors of cooperatives in the area served by the\nregional council;\n(d) One (1) parent of a child with a behavioral health need, who is or has been a\nconsumer of system of care services and supports, and one (1) parent who\nmeets the same crit eria to serve as the parent member's alternate, who may\nattend and participate in all council meetings, but shall vote only in the\nabsence of the parent member. For each appointment to be made, the regional\ninteragency council for which the appointment is to be made shall submit to\nthe chair of the State Interagency Council for Services and Supports to\nChildren and Transition-Age Youth a list of two (2) names of parents who are\nqualified for appointment from which list the chair of the State Interagency\nCouncil for Services and Supports to Children and Transition-Age Youth shall\nmake the appointment. Appointees shall serve a term of two (2) years, and\nmay be reappointed to additional two (2) year terms. If the child of the parent\nmember or alternate parent member ceases to be a consumer of system of care\nservices and supports during the term of appointment, the member shall be\neligible to serve out the remainder of the term of appointment;\n(e) One (1) transition-age youth who has a behavioral health disorder and who is\nreceiving or has received a service to address mental health, substance use, or\nco-occurring mental health and substance use disorder, and one (1) transition -\nage youth who meets the same criteria to serve as the youth member's\nalternate in the a bsence of the youth member. For each appointment to be\nmade, the regional interagency council for which the appointment is to be\nmade shall submit to the chair of the State Interagency Council for Services\nand Supports to Children and Transition-Age Youth a list of two (2) names of\ntransition-age youth who are qualified for appointment from which list the\nchair of the State Interagency Council for Services and Supports to Children\nand Transition-Age Youth shall make the appointment. Appointees shall serve\na term of two (2) years, and may be reappointed to additional two (2) year\nterms. If the youth member or alternate youth member ceases to be a\nconsumer of system of care services and supports during the term of\nappointment, the member shall be eligible to s erve out the remainder of the\nterm of appointment;\n(f) Any other local public or private agency that provides services and supports to\nchildren and transition -age youth with behavioral health needs which the\nregional interagency council may invite to have a representative become a\npermanent or temporary member of the council; and\n(g) One (1) representative from each of the Department of Juvenile Justice,\nfamily resource and youth services centers, the Kentucky Office of Vocational\nRehabilitation, the Depart ment for Community Based Services, and local\nhealth departments.\n(2) A member of a regional interagency council for the system of care shall not be\ngiven compensation in addition to that which they already receive as service\nproviders or state employees, e xcept that the parent and youth members and\nalternate parent and youth members of regional interagency councils shall be\nreimbursed by the regional interagency council's contracted fiscal agent for all\nexpenses incurred through the performance of their dut ies as council members if it\nis outside the scope of their job duties.\n(3) Each regional interagency council for the system of care shall perform the\nfollowing functions:\n(a) Conduct regional system of care planning and operations;\n(b) Coordinate system-level continuous quality improvement;\n(c) Identify and develop system of care expansion opportunities;\n(d) Promote awareness of the system of care;\n(e) Initiate and adopt intera gency agreements as necessary for providing services\nand supports to children and transition -age youth with or at risk of behavioral\nhealth needs by the agencies represented in the regional council; and\n(f) Advise the state interagency council regarding th e system of care within the\nregion.\n(4) The secretary of the Cabinet for Health and Family Services and the designee of the\nKentucky Department of Education shall ensure that regional interagency councils\nfor the system of care are formed.\n(5) Local interagency councils for the system of care may be formed at the discretion of\na regional interagency council to advance the functions of the regional interagency\ncouncil at the city, county, or other local community level.","path":["KRS Chapter 200"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57489","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:56Z","sha256":"0f4e57725e87a1d69c960812a205a7f0688f09c019cf986ad63c02cece6d00c7","source_id":"us-ky","stale":false,"prev":"us-ky/krs-200.508","next":"us-ky/krs-200.550"},"notice":"GroundRules: Original legal text.
