{"data":{"id":"us-ky/krs-200.654","jurisdiction":"us-ky","citation":"KRS 200.654","heading":"Definitions for KRS 200.650 to 200.676.","body":"As used in KRS 200.650 to 200.676, unless the context requires otherwise:\n(1) \"Awards and contracts\" means the state and federal funds designated by the cabinet\nfor projects relating to planning, resource development, or provision of direct early\nintervention services, as defined in this section, to infants and toddlers with\ndisabilities and their families;\n(2) \"Cabinet\" means the Cabinet for Health and Family Services;\n(3) \"Child find\" means a system to identify, locate, and evaluate all infants and toddlers\nwith disabilities who are eligible for early intervention services, determine which\nchildren are receiving services, and coordinate the effort with other state agencies\nand departments;\n(4) \"Council\" means the Kentucky Early Intervention System Interagency Coordinating\nCouncil;\n(5) \"District\" means one (1) of the fifteen (15) area development districts;\n(6) \"District early intervention committee\" means an interagency coordinating\ncommittee established within each of the fifteen (15) area development dist ricts to\nfacilitate interagency coordination at the district level;\n(7) \"Early intervention services\" means services for infants and toddlers with\ndisabilities and their families delivered according to an individualized family\nservice plan developed by the  child multidisciplinary team to meet the\ndevelopmental needs of eligible children, as defined in this section, and provided by\nentities receiving public funds using qualified personnel. The individualized family\nservices plan is developed and the services  are provided in collaboration with the\nfamilies and, to the maximum extent appropriate, in natural environments,\nincluding home and community settings in which infants and toddlers without\ndisabilities would participate. These services are necessary to en able the child to\nreach maximum potential. Services to be made available shall include but not be\nlimited to the following:\n(a) Screening services;\n(b) Evaluation services;\n(c) Assessment services;\n(d) Service coordination;\n(e) Transportation and related costs for accessing early intervention services;\n(f) Family services including counseling, psychological, and social work services;\n(g) Health services including medical services for diagnostic and evaluation\npurposes only;\n(h) Nutrition services;\n(i) Occupational therapy services;\n(j) Physical therapy services;\n(k) Communication development services;\n(l) Sensory development services;\n(m) Developmental intervention services;\n(n) Assistive technology services; and\n(o) Respite services;\n(8) \"Early intervention system\" means the management structure established in KRS\n200.654 to 200.670 and which is comprised of the interdependent array of services\nand activities for the provision of a statewide, comprehensive, coordinated,\nmultidisciplinary, interagency program for infants and toddlers with disabilities and\ntheir families;\n(9) \"Individual family service plan\" means the singular comprehensive written service\nplan developed by the child's multidisciplinary team, with the child's parents serving\nas fully participating members of the team, to be followed by all agencies and other\nentities involved in providing early intervention services to an infant or toddler with\ndisabilities and the child's family;\n(10) \"Infants and toddlers with disabilities\" and \"eligible children\" mean children from\nbirth to thirty -six (36) months of age in need of early intervention services as a\nresult of one (1) of the following circumstances:\n(a) The child is experiencing developmental delays, as measured by diagnostic\ninstruments and procedures in one (1) or more of the following skill areas:\nphysical; cognitive; communication; social or emotional; or adaptive\ndevelopment;\n(b) The child has a diagnosed physical or mental condition which has a high\nprobability of resulting in developmental delay; or\n(c) The child has a diagnosis of pervasive developmental disorder;\n(11) \"Multidisciplinary team\" means the child-specific group responsible for determining\nthe services needed by the infant or toddler with disabilities and the child's family,\nand development of the individualized family services plan. The team for each child\nshall include the parent or guardian of the child and individuals representing at least\ntwo (2) applicable disciplines which may include but need not be limited to the\nfollowing: physical therapy; speech therapy; social work; nursing; or education;\n(12) \"Point of entry\" means an easily identifiable, highly accessible nonstigmatized entry\ninto services; and\n(13) \"Qualified service provider\" means an entity, including but not  limited to an\nindividual, program, department, or agency, responsible for the delivery of early\nintervention services to eligible infants and toddlers with disabilities and their\nfamilies who has met the highest minimum standards of state -approved or\nrecognized certification, licensing, registration, or other comparable requirements\nthat apply to the area in which the entity is providing early intervention services.","path":["KRS Chapter 200"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=7323","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:56Z","sha256":"55ab5cc1a1de1957b7abbf5d6fb19b1d68d1cd77e57ab40034a8cbb9f57a7759","source_id":"us-ky","stale":false,"prev":"us-ky/krs-200.652","next":"us-ky/krs-200.656"},"notice":"GroundRules: Original legal text.
