{"data":{"id":"us-ky/krs-200.658","jurisdiction":"us-ky","citation":"KRS 200.658","heading":"Kentucky Early Intervention System Interagency Coordinating Council --","body":"Membership -- Duties -- Annual report -- Conflict of interest to bar voting.\n(1) There is hereby created the Kentucky Early Intervention System Interagency\nCoordinating Council to be comprised of twenty-five (25) members to be appointed\nby the Governor to serve a term of three (3) years. The members of the council shall\nbe geographically and culturally representative of the population of the\nCommonwealth and conform to the requirements of federal law and regulations. For\nadministrative purposes, the council shall be attached to the Early Childhood\nAdvisory Council. Pursuant to federal law and regulations, the membership shall be\nas follows:\n(a) At least five (5) members shall be the parents, including minority parents, of a\nchild with a disability who is twelve (12) years of age or less, with at least one\n(1) being the parent of a child six (6) years of age or less. Each parent shall\nhave knowledge of or experience with program s for infants and toddlers with\ndisabilities;\n(b) At least five (5) members shall be public or private providers of early\nintervention services to infants and toddlers with disabilities;\n(c) At least one (1) member shall be a member of the Kentucky General\nAssembly;\n(d) At least one (1) member shall be representative of an entity responsible for\npersonnel preparation and may include personnel from an institution of higher\neducation or preservice training organization;\n(e) At least one (1) member shall be th e commissioner or individual serving in a\nposition of equivalent authority, or the designee, from the Department for\nPublic Health;\n(f) At least one (1) member shall be the commissioner or individual serving in a\nposition of equivalent authority, or the de signee, from the Department for\nMedicaid Services;\n(g) At least one (1) member shall be the commissioner or individual serving in a\nposition of equivalent authority, or the designee, from the Department for\nBehavioral Health, Developmental and Intellectual Disabilities;\n(h) At least one (1) member shall be the commissioner or individual serving in a\nposition of equivalent authority, or the designee, from the Department for\nCommunity Based Services;\n(i) At least one (1) member shall be the commissioner or de signee of the\nDepartment of Education;\n(j) At least one (1) member shall be the commissioner or designee of the\nDepartment of Insurance;\n(k) At least one (1) member shall be a representative of the Office for Children\nwith Special Health Care Needs;\n(l) At least one (1) member shall be a representative for the Head Start program;\nand\n(m) At least one (1) member shall be a representative of the Education of\nHomeless Children and Youth program.\n(2) In matters concerning the Kentucky Early Intervention System, the council shall\nadvise and assist the cabinet in areas, including but not limited to the following:\n(a) Development and implementation of the statewide system and the\nadministrative regulations promulgated pursuant to KRS 200.650 to 200.676;\n(b) Achieving the full participation, coordination, and cooperation of all\nappropriate entities in the state, including, but not limited to, individuals,\ndepartments, and agencies, through the promotion of interagency agreements;\n(c) Establishing a process to seek information from service providers, service\ncoordinators, parents, and others concerning the identification of service\ndelivery problems and the resolution of those problems;\n(d) Resolution of disputes, to the extent deemed appropriate by the cabinet;\n(e) Provision of appropriate services for children from birth to three (3) years of\nage;\n(f) Identifying sources of fiscal and other support services for early intervention\nprograms;\n(g) Preparing applications to Part C of the Federal Individuals with Disabilities\nEducation Act (IDEA) and any amendments to the applications;\n(h) Transitioning of infants and toddlers with disabilities and their families from\nthe early intervention system to appropriate se rvices provided under Part B of\nthe Federal Individuals with Disabilities Education Act (IDEA) operated by\nthe state Department of Education; and\n(i) Developing performance measures to assess the outcomes for children\nreceiving services.\n(3) The council sh all prepare no later than December 30 of each year an annual report\non the progress toward and any barriers to full implementation of the Kentucky\nEarly Intervention System for infants and toddlers with disabilities and their\nfamilies. The report shall inc lude recommendations concerning the Kentucky Early\nIntervention System, including recommendations of ways to improve quality and\ncost effectiveness, and shall be submitted to the Governor, Legislative Research\nCommission, and the Secretary of the United States Department of Education.\n(4) No member of the council shall cast a vote on any matter which would provide\ndirect financial benefit to that member or otherwise give the appearance of the\nexistence of a conflict of interest.","path":["KRS Chapter 200"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=40945","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:56Z","sha256":"162d28133a98d6d8e481b598d7761e305b1d3b4b3d9182bd200ebf2b475d224c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-200.656","next":"us-ky/krs-200.660"},"notice":"GroundRules: Original legal text.
