{"data":{"id":"us-ky/krs-201.100","jurisdiction":"us-ky","citation":"KRS 201.100","heading":"Procedure for commitment -- Appeals.","body":"(1) When a child comes under any of the provisions of KRS 201.090, the board may\nfile a petition in the juvenile session of the District Court setting forth the facts in\nregard to the child. The court shall thereupon issue a writ for the custody of the\nchild, and the writ shall be served upon the parents or the person having actual\ncustody or control of the child, or if the child is under no actual parental custody or\ncontrol, then upon the child itself. If the writ is served upon the child, the board\nshall pla ce the child in the temporary custody of the home, or of some private\nperson or public agency until the final order of the court. Notice of the time of the\nhearing shall be served on the parents or the person having actual custody or control\nof the child, and such person shall have the right to call witnesses and be heard as to\nhis rights, fitness and ability to care for and educate the child.\n(2) If the facts set forth in the petition are found to be true and any of the conditions set\nforth in KRS 201.090 exist, the court shall order that the child be committed to the\ncustody of the board. If the parents are able to maintain and support the child, the\ncourt shall require them to pay board, and may enforce such payment by attachment\nor other proceedings as in cases of contempt.\n(3) An appeal may be taken from any orders, judgments or commitments made under\nthe provisions of this section according to the procedures established in KRS\n610.130 for appeals from the juvenile session of District Court.","path":["KRS Chapter 201"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=7350","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:57Z","sha256":"984945f76f5e4ce48198b53fda542914b8e4ad77a41b81693a7f7f7de46abbf2","source_id":"us-ky","stale":false,"prev":"us-ky/krs-201.090","next":"us-ky/krs-201.110"},"notice":"GroundRules: Original legal text.
