(Effective","body":"until October 1, 2026)\nNo person shall be court-ordered to assisted outpatient mental health treatment unless the\nperson:\n(1) Is diagnosed with a serious mental illness;\n(2) Has a history of repeated nonadherence with mental health treatment, which has:\n(a) At least twice within the last forty-eight (48) months, been a significant factor\nin necessitating hospitalization or arrest of the person; or\n(b) Within the last t wenty-four (24) months, resulted in an act, threat, or attempt\nat serious physical injury to self or others;\n(3) Is unlikely to adequately adhere to outpatient treatment on a voluntary basis based\non a qualified mental health professional's:\n(a) Clinical observation; and\n(b) Identification of specific characteristics of the person's clinical condition that\nsignificantly impair the person's ability to make and maintain a rational and\ninformed decision as to whether to engage in outpatient treatment voluntari ly;\nand\n(4) Is in need of court -ordered assisted outpatient treatment as the least restrictive\nalternative mode of treatment presently available and appropriate.\nEffective: July 14, 2022","path":["KRS Chapter 202A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52564","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:59Z","sha256":"01b0e18bee780a31329e3576d9b43d4270a182ed80b9f259da783d38984769e6","source_id":"us-ky","stale":false,"prev":"us-ky/krs-202a.0813","next":"us-ky/krs-202a.0817"},"notice":"GroundRules: Original legal text.
