(Effective until October 1, 2026)\n(1) The court which orders any person to the receiving hospital or psychiatric facility,\nunder the provisions of this cha pter, shall at once notify the receiving hospital or\npsychiatric facility that such order has been made, advising of the sex and condition\nof the person.\n(2) After the facility has been so notified, the court shall order the sheriff of the county\nor other peace officer to transport the patient within forty -eight (48) hours\n(excluding weekends and holidays) from the county in which the person is located\nto the hospital or psychiatric facility designated by the cabinet. The sheriff or other\npeace officer may,  upon agreement of a person authorized by the peace officer,\nauthorize the cabinet, a private agency on contract with the cabinet, or an\nambulance service designated by the cabinet to transport the person to the hospital.\n(3) The transportation costs of transporting a person to a hospital or psychiatric facility,\nwhen performed by a peace officer, an ambulance service, or other private agency\non contract with the cabinet shall be paid by the cabinet in accordance with\nadministrative regulation promulgated b y the cabinet under the provisions of KRS\nChapter 13A.\n(4) In returning any patient to the county from which the patient is sent, the\ntransportation cost of the sheriff or other peace officer, the ambulance service, or\nthe other agency on contract with the  cabinet transporting the patient shall be paid\nas provided in KRS 202A.028(4), when necessary.\n(5) Whenever an individual is involuntarily hospitalized by a court order the patient\nshall be transported to the hospital designated by the cabinet and accompa nied by\nthe following documents:\n(a) A copy of the petition for involuntary hospitalization, unless hospitalization\ntakes place pursuant to KRS 202A.041;\n(b) The certificate of qualified mental health professionals; and\n(c) The order of involuntary hospitalization.\n(6) The hospital may refuse to receive any person who has been ordered to be\ninvoluntarily hospitalized by a court order if the papers presented with such person\nat the hospital do not comply with the provisions of this chapter or if it does not\nreceive notification of the order of involuntary hospitalization as required by this\nchapter.\nEffective: July 15, 1994","path":["KRS Chapter 202A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=7466","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:59Z","sha256":"306ac39c8b9bec534df68d44b0392b816fa08925168bc1ea004932688bf54903","source_id":"us-ky","stale":false,"prev":"us-ky/krs-202a.100","next":"us-ky/krs-202a.110"},"notice":"GroundRules: Original legal text.
