{"data":{"id":"us-ky/krs-202a.181","jurisdiction":"us-ky","citation":"KRS 202A.181","heading":"Convalescent leave status.","body":"(1) An authorized staff physician may release an involuntary patient on convalescent\nleave status when the physician concludes that the patient would not present a\ndanger or a threat of danger to self or others if provided with continued medical\nsupervision in  a less restrictive alternative mode of treatment. Release on\nconvalescent leave status shall include notification to the hospitalizing court.\nRelease on convalescent leave status does not terminate the involuntary\nhospitalization order and shall include p rovisions for the development of a\ntreatment plan jointly by the hospital and by a provider of outpatient care for\nfollow-up care by the provider and for the continual monitoring of that patient's\ncondition by the provider.\n(2) The hospital from which such  patient is given convalescent leave status may at any\ntime readmit the patient without additional court proceedings. If there is reason to\nbelieve that it is to the best interest of the patient to be rehospitalized, the secretary\nor an authorized staff physician of the hospital may issue an order for the immediate\nrehospitalization of the patient. Such an order, if not voluntarily complied with,\nshall, upon the endorsement by a judge of any court of the county in which the\npatient is a resident or is prese nt, authorize any health or police officer to take the\npatient into custody and transport him to the responsible hospital. Notice of\nrehospitalization under this section shall be given to the originating court as soon as\npracticable and simultaneously with  the order directing the rehospitalization if\npossible.\n(3) Release on convalescent leave status shall not apply to persons held under\nhospitalization orders arising out of KRS Chapter 504 unless consent of the\nappropriate court is obtained.","path":["KRS Chapter 202A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=7481","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:51:59Z","sha256":"acb6035d47b212e7901664e4d58fb852442c3b4126be4d057d4fca2e79568fe6","source_id":"us-ky","stale":false,"prev":"us-ky/krs-202a.180","next":"us-ky/krs-202a.185"},"notice":"GroundRules: Original legal text.
