(Effective until October 1, 2026)","body":"(1) Upon receipt of a certificate of the United States Public Health Service or such\nother agency of the United States government that facilities are available for the\ncare or treatment of any person heretofore hospitalized in any mental hospital or\nother institution in this state for the care of mentally ill persons and that such person\nis eligible for such care or treatment, the secretary, upon recommendation by any\nsuch hospital or institution in this state, is hereby authorized to cause the transfer of\nany such person to the United States Public Health Service or other agency of the\nUnited States government for care or treatment. Upon effecting any such transfer,\nthe hospitalizing court shall be notified thereof by the secretary.\n(2) Any person transferred as provided in this section shall be deemed to be placed in\nthe custody of the United States Public Health Service or other agency of the United\nStates government pursuan t to the original hospitalization the same as if he had\nbeen originally so hospitalized.\n(3) No person shall be transferred to any agency of the United States if he be confined\npursuant to conviction of any felony or misdemeanor or if he has been acquitted  of\nthe charge solely on the ground of mental illness unless prior to transfer the court\nissuing the confining order shall enter an order to transfer after the motion and\nhearing.
