{"data":{"id":"us-ky/krs-202a.410","jurisdiction":"us-ky","citation":"KRS 202A.410","heading":"Duty of administrator to warn law enforcement agency, prosecutor, and","body":"Department of Corrections upon discharge, transfer, or escape of involuntarily\ncommitted patient charged or convicted of a violent crime -- Immunity for\nacting in good faith -- Notification of victim -- Administrative regulations.\n(1) When a patient who has been involuntarily committed to a psychiatric facility or\nforensic psychiatric facility and who has been charged with or convicted of a violent\ncrime as defined in KRS 439.3401  is discharged or transferred from the facility, the\nadministrator shall notify the law enforcement agency in the county to which the\nperson is to be released, the prosecutor in the county where the violent crime was\ncommitted, and the Department of Corrections.\n(2) If a patient who has been involuntarily committed to a psychiatric facility or\nforensic psychiatric facility and who has been charged with or convicted of a violent\ncrime as defined in KRS 439.3401 escapes from the facility, the administrator sh all\nnotify the law enforcement agency in the county in which the facility is located, the\nprosecutor in the county where the violent crime was committed, and the\nDepartment of Corrections.\n(3) The administrator of a psychiatric facility or forensic psychia tric facility, or the\nadministrator's designee, who acts in good faith in making the notifications required\nin this section or is unable to provide the release information required, is immune\nfrom any civil liability.\n(4) The Department of Corrections shal l notify, or contract with a private entity to\nnotify, victims of crime, judges, and witnesses involved in the hearing that resulted\nin the involuntary commitment who have made a notification request of the\ndischarge or escape of a patient from a psychiatr ic facility or forensic psychiatric\nfacility.\n(5) The Department of Corrections and the Cabinet for Health and Family Services\nshall each promulgate administrative regulations under KRS Chapter 13A to carry\nout the duties set forth in this statute.","path":["KRS Chapter 202A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=40924","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:00Z","sha256":"89122a6d66a814ecbf2e5a493faec7021777203b2cb37a0170ff3f0b6996b043","source_id":"us-ky","stale":false,"prev":"us-ky/krs-202a.400","next":"us-ky/krs-202a.420"},"notice":"GroundRules: Original legal text.
