{"data":{"id":"us-ky/krs-202a.424","jurisdiction":"us-ky","citation":"KRS 202A.424","heading":"Powers of designated surrogate.","body":"(1) A surrogate designated by a grantor in an advance directive for mental health\ntreatment shall act on behalf of the grantor in accordance with the desires of the\ngrantor as indicated in the advance directive and may override the advance directive\nonly if th ere is substantial medical evidence that failing to do so would result in\nharm to the grantor.\n(2) When acting on behalf of the grantor, the surrogate shall consider the\nrecommendations of the health care provider and honor the decisions made by the\ngrantor as expressed in the advance directive.\n(3) If the grantor's instructions or preferences are not stated in the advance directive, the\nsurrogate may act in good faith on behalf of the grantor in the manner that the\nsurrogate believes the grantor would act.\n(4) A surrogate may resign at any time by giving written notice to the grantor, to the\nimmediate successor surrogate, if any, to the attending health care provider, or to\nthe health care facility.","path":["KRS Chapter 202A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=7503","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:00Z","sha256":"eb9875e66b535ac8bd15484adea0db8144ff2e1e2d08b8908484458a5abacb5b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-202a.422","next":"us-ky/krs-202a.426"},"notice":"GroundRules: Original legal text.
