{"data":{"id":"us-ky/krs-202a.426","jurisdiction":"us-ky","citation":"KRS 202A.426","heading":"Refusal to comply with advance directive or surrogate's decision -- Effect","body":"of refusal.\n(1) A health care provider or health care facility shall provide mental health treatment\nthat complies with the instructions in an advance directive to the fullest  extent\npossible when the instructions are within standards for mental and physical health\ncare and permitted by state and federal law.\n(2) A health care provider or health care facility may override expressed refusals of\ntreatment only if:\n(a) A court order contradicts the advance directive; or\n(b) There is an emergency endangering a person's life or posing a serious risk to\nphysical health.\n(3) Deviations from expressed preferences in an advance directive shall be documented\nby the health care provider or health care facility in the grantor's medical record.\n(4) A health care provider or health care facility that refuses to comply with an advance\ndirective of a grantor or a decision made by a surrogate shall:\n(a) Immediately inform the grantor or surrogate , if one is designated, of the\nrefusal; and\n(b) Not impede the transfer of the grantor to another health care provider or health\ncare facility.","path":["KRS Chapter 202A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=7504","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:00Z","sha256":"ef9be598453e93517a57c56b459564ef47517fdd19855202e2a1d9ced9c611c5","source_id":"us-ky","stale":false,"prev":"us-ky/krs-202a.424","next":"us-ky/krs-202a.428"},"notice":"GroundRules: Original legal text.
