{"data":{"id":"us-ky/krs-202b.045","jurisdiction":"us-ky","citation":"KRS 202B.045","heading":"Requirements for admission -- Discharge planning.","body":"(1) Admission:\n(a) Residents shall be admitted only upon the approval of an interdisciplinary\nteam. The facility shall admit only persons who have a physical or mental\ncondition which requires developmental nursing services and a planned\nprogram of active treatment;\n(b) The interdisciplinary team shall:\n1. Conduct a comprehensive evaluation of the individual, not more than\nthree (3) months before admission, covering physical, emotional, social,\nand cognitive factors; and\n2. Prior to admission define the need for service witho ut regard to\navailability of those services. The team shall review all available and\napplicable programs of care, treatment, and training and record its\nfindings;\n(c) If admission is not the best plan but the individual must be admitted\nnevertheless, the f acility shall clearly acknowledge that the admission is\ninappropriate and initiate plans to actively explore alternatives;\n(d) Before admission, the resident and a responsible member of his family or\nguardian shall be informed in writing of the established  policies of the facility\nand fees, reimbursement, visitation rights during serious illness, visiting\nhours, type of diets offered, and services offered; and\n(e) The facility shall provide and maintain a system for identifying each resident's\npersonal property and facilities for safekeeping of his declared valuables. Each\nresident's clothing and other property shall be reserved for the resident's own\nuse.\n(2) Discharge planning. Prior to discharge the facility shall have a postinstitutional plan\nwhich identifies the residential setting and support services which would enable the\nresident to live in a less restrictive alternative to the current setting. Before a\nresident is released, the facility shall:\n(a) Offer counseling to parents or guardians who request  the release of a resident\nconcerning the advantages and disadvantages of the release;\n(b) Plan for release of the resident, to assure that appropriate services are\navailable in the resident's new environment, including protective supervision\nand other follow-up services; and\n(c) Prepare and place in the resident's record a summary of findings, progress, and\nplans.","path":["KRS Chapter 202B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=7518","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:00Z","sha256":"e0a740f4fbe02aee71753d96f80f178ca0f7f67a8f421d9cf9067abc43b47254","source_id":"us-ky","stale":false,"prev":"us-ky/krs-202b.040","next":"us-ky/krs-202b.050"},"notice":"GroundRules: Original legal text.
