The regulations shall include, but shall not be limited to:\n(1) Rights of residents with an intellectual disability and their families to be adequately\ninformed as to the individual treatment program of the resident;\n(2) Rights of residents and their families to assist in the planning of the treatment\nprogram of the resident;\n(3) Rights of residents and their families under certain conditions to refuse treatment\noffered to the resident by the hospital or ICF/ID;\n(4) Rights of residents to maintain, keep, and use personal possessions and money;\n(5) Rights of residents to meet with friends and relatives;\n(6) Rights of residents to receive payment for work performed on behalf of the hospital\nor ICF/ID;\n(7) Rights of residents to refuse intrusive treatments, including electroshock or\npsychosurgery;\n(8) Rights of residents to seek relief from participating in their treatment plans;\n(9) Rights of residents who are minors to seek relief from actions, approved by their\nparents or guardians, for or against admission and discharge;\n(10) The use of seclusion and other mechanical restraints in hospitals and ICF/IDs;\n(11) The release of residents to less restrictive alternative modes of treatment on\nconvalescent status; and\n(12) Provisions for alternative methods for involuntary admission.","path":["KRS Chapter 202B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=40773","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:00Z","sha256":"4897a284ded1fd668d4ae0da497386331dcd936d3f3eba2a50b7202798b75fbb","source_id":"us-ky","stale":false,"prev":"us-ky/krs-202b.050","next":"us-ky/krs-202b.070"},"notice":"GroundRules: Original legal text.
