{"data":{"id":"us-ky/krs-202b.070","jurisdiction":"us-ky","citation":"KRS 202B.070","heading":"Exemption from personal liability -- Duty of individuals with direct -care","body":"responsibility for residents of ICF/ID to meet specific care needs, including\nsupervision.\n(1) Persons carrying out duties or rendering professional opinions as provided in t his\nchapter shall be free of personal liability for such actions provided that such\nactivities are performed in good faith within the scope of their official duties and in\na manner consistent with accepted professional practices.\n(2) (a) The person respons ible for the implementation of the individual care plan\nshall ensure that each individual that has direct -care responsibility for a\nresident admitted to an ICF/ID shall be informed of the specific care needs of\nthe resident, including but not limited to the need for supervision.\n(b) After admittance, the facility administrator shall ensure that each individual\nthat has direct-care responsibility for a resident admitted to an ICF/ID shall be\ninformed of the specific care needs of the resident, including but not limited to\nthe need for supervision upon any change in the resident's care plan.\n(3) Notwithstanding subsection (1) of this section, an individual who has direct -care\nresponsibility for a resident of an ICF/ID and who intentionally fails to provide\nsupervision of the resident as specified in the resident's care plan and thereby\ncreates a risk of imminent harm or death to the resident shall be subject to\nimmediate dismissal from employment.","path":["KRS Chapter 202B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=40774","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:00Z","sha256":"6751ab4322f39df1f59b6288b22b026ad947e42ff7dc4572f0d3348a7e219d66","source_id":"us-ky","stale":false,"prev":"us-ky/krs-202b.060","next":"us-ky/krs-202b.080"},"notice":"GroundRules: Original legal text.
