{"data":{"id":"us-ky/krs-202b.250","jurisdiction":"us-ky","citation":"KRS 202B.250","heading":"Review hearing -- Procedures -- Disposition -- Requested hearing by","body":"resident or certain persons.\n(1) No less than once in every five (5) years following the initial order for involuntary\nadmission of a resident to an ICF/ID, or an order authorizing  continued care and\ntreatment following review pursuant to this section, the court shall hold a hearing to\nreview the status of the resident and necessity for continued care and treatment in\nthe ICF/ID. Notice at least twenty (20) days in advance of the he aring shall be\nprovided by the court to the ICF/ID, county attorney, guardian or limited guardian\nof the resident, if any, or, if none, an immediate family member as listed on the last\ninterdisciplinary report filed by the ICF/ID. The court shall appoint a n attorney to\nrepresent the resident at the review hearing.\n(2) The review hearing may be informal and held in open court, in chambers, or at the\nICF/ID. The hearing shall be held without a jury and the resident shall be entitled to\npresent documentary evi dence and witnesses and cross -examine witnesses against\nthe resident.\n(3) At the conclusion of the review hearing, the court shall make written findings of\nfact concerning whether the criteria for involuntary admission set forth in KRS\n202B.040 continue to be satisfied based upon clear and convincing evidence. If the\ncourt finds that the involuntary admission criteria continue to be satisfied, the court\nshall enter an order authorizing the continued care and treatment of the resident at\nthe ICF/ID and shall establish the period within which the next review shall be held.\nOtherwise, the court shall enter an order requiring the resident to be discharged\nfrom the ICF/ID.\n(4) If at any point during the resident's placement at an ICF/ID it appears that the\nresident no longer meets the criteria for involuntary admission set forth in KRS\n202B.040, the resident, the resident's parent, guardian or limited guardian,\nimmediate family member, or attorney may request a review pursuant to this\nsection.","path":["KRS Chapter 202B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=40787","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:00Z","sha256":"7d89a494eab8bc582523b6c5489705449c1fac8275293d6ff4473700fdd2eaa4","source_id":"us-ky","stale":false,"prev":"us-ky/krs-202b.245","next":"us-ky/krs-202b.260"},"notice":"GroundRules: Original legal text.
