{"data":{"id":"us-ky/krs-202b.300","jurisdiction":"us-ky","citation":"KRS 202B.300","heading":"Return of Kentucky residents from other states -- Determination of need","body":"for further admission.\n(1) Legal residents of the state who have become public charges in other states and\nhave been returned to Kentucky because they have been involuntarily a dmitted may\nbe immediately admitted to an ICF/ID at the request of the secretary or the\nsecretary's designated representative.\n(2) Within seventy-two (72) hours, excluding weekends and holidays, of the admission\ndate, the staff of the ICF/ID shall determin e the need of the person for further\nadmission. If two (2) qualified professionals in the area of intellectual disabilities, at\nleast one (1) of whom is a physician, conclude that the person shall be involuntarily\nadmitted, they shall file in the appropria te court a certification requesting\ninvoluntary admission procedures be initiated under the provisions of this chapter,\nunless the person has agreed to remain voluntarily and possesses the mental\ncapacity to give informed consent for voluntary admission.","path":["KRS Chapter 202B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=40791","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:00Z","sha256":"fce1029f2a162aa4cda9e484b85bf1e537677176c5d772c42f959ea0aef61acf","source_id":"us-ky","stale":false,"prev":"us-ky/krs-202b.290","next":"us-ky/krs-202b.990"},"notice":"GroundRules: Original legal text.
