{"data":{"id":"us-ky/krs-202c.150","jurisdiction":"us-ky","citation":"KRS 202C.150","heading":"Psychiatric facility review committee -- Treatment plan.","body":"(1) Every  forensic psychiatric facility caring for respondents involuntarily\ncommitted under this chapter shall have a review committee of three (3)\nqualified mental health professionals appointed by the facility director. This\nreview committee shall have the authority to review the appropriateness of a\nrespondent's individual treatment plan.\n(2) Upon  the refusal of a respondent to participate in any or all aspects of his or\nher treatment plan, the review committee shall examine the appropriateness of\nthe respondent's individual treatment plan. Within three (3) days of the refusal,\nthe review committee shall meet with the respondent and his or her counsel,\nguardian ad litem, or other representative to discuss its recommendations.\n(3) If the respondent still refuses to participate in any or all aspects of his or her\nindividual treatment plan, the forensic psychiatric facility may petition the Circuit\nCourt for a de novo determination of the appropriateness of the proposed\ntreatment. Within seven (7) days, excluding weekends and holidays, the court\nshall conduct a hearing, consistent with the respondent's rights to due process\nof law, and shall utilize the following factors in reaching its determination:\n(a) Whether the treatment is necessary to protect the respondent or others\nfrom harm;\n(b) Whether  the respondent is incapable of giving informed consent to the\nproposed treatment;\n(c) Whether any less restrictive alternative mode of treatment exists; and\n(d) Whether  the proposed treatment carries any risk of permanent side\neffects.\n(4) Upon  the completion of the hearing, the court shall enter an appropriate\njudgment.","path":["KRS Chapter 202C"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=50879","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:01Z","sha256":"7263a3243665984b5aea87c40994dd30085dbb91c5a9668967cfe5930be7a372","source_id":"us-ky","stale":false,"prev":"us-ky/krs-202c.140","next":"us-ky/krs-202c.160"},"notice":"GroundRules: Original legal text.
