{"data":{"id":"us-ky/krs-205.010","jurisdiction":"us-ky","citation":"KRS 205.010","heading":"Definitions for chapter.","body":"As used in this chapter, unless the context requires otherwise:\n(1) \"Cabinet\" means the Cabinet for Health and Family Services;\n(2) \"Secretary\" means the secretary for health and family services or his authorized\nrepresentative;\n(3) \"Public assistance\" means money grants, assistance in kind, or services to or for the\nbenefit of needy aged, needy blind, needy permanently and totally disabled persons,\nneedy children, or persons with whom a needy child lives or a family containing a\ncombination of these catego ries, except that the term shall not be construed to\npermit the granting of financial aid where the purpose of such aid is to obtain an\nabortion. For purposes of this section and KRS 205.560, \"abortion\" means an act,\nprocedure, device, or prescription administered or prescribed for a pregnant woman\nby any person, including the pregnant woman herself, producing premature\nexpulsion of the fetus. Abortion does not include an induced premature birth\nintended to produce a live viable child;\n(4) \"Needy child\" means a child who has been deprived of parental support by reasons\nprescribed by regulations within the scope of Title IV of the Social Security Act, its\namendments, and federal regulations and who does not have otherwise provided for\nhim a subsistence compatible with decency and health;\n(5) \"Parent,\" in addition to biological or adoptive parent, shall include stepparent;\n(6) \"Needy aged\" means a person who has attained the age of sixty-five (65) and who is\nunable to provide for himself and who does not have o therwise provided for him a\nsubsistence compatible with decency and health;\n(7) \"Needy blind\" means a person who has no vision or whose vision is so defective as\nto prevent the performance of ordinary activities for which eyesight is essential and\nwho is unable to provide for himself and who does not have otherwise provided for\nhim a subsistence compatible with decency and health;\n(8) \"Person with whom a needy child lives\" means the individual prescribed by\nregulation, with whom such child is living in a pl ace of residence maintained by\nsuch individual by himself or together with one (1) or more other persons;\n(9) \"Needy permanently and totally disabled\" means a person eighteen (18) years of age\nor older and who has a permanent physical or mental impairment,  disease, or loss\nthat substantially precludes him from engaging in useful occupations within his\ncompetence and who is unable to provide for himself and who does not have\notherwise provided for him a subsistence compatible with decency and health;\n(10) \"Private institution\" means any establishment or place other than a public institution\noperated or maintained by any individual, association, corporation, or other\norganization which provides a group living arrangement for four (4) or more\nindividuals, who a re cared for and maintained in residence for compensation or\notherwise;\n(11) \"Public institution\" means any establishment or place which is the responsibility of\nand administered by the state or any political subdivision thereof providing a group\nliving ar rangement in which one (1) or more individuals are cared for and\nmaintained in residence;\n(12) \"Public medical institution\" means any public institution the primary purpose of\nwhich is to furnish hospital care and medical treatment;\n(13) \"Person determined to be potentially responsible\" means any person who:\n(a) Is not aged, blind, disabled, incapacitated, or needed in the home:\n1. Because of the illness or incapacity of a member of the family; or\n2. Because of children in the home under the age of six (6); or\n(b) Volunteers for such determination;\n(14) Nothing in this section shall be deemed to deprive a woman of all appropriate\nmedical care necessary to prevent her physical death;\n(15) \"Adult day-care center\" means any adult care facility which provides part-time care,\nday or night, but less than twenty -four (24) hours, to at least four (4) adults not\nrelated to the operator of the adult care facility by blood, marriage, or adoption.","path":["KRS Chapter 205"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=7624","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:02Z","sha256":"29c665a712bc490c3f02f8d083fbaaaa175a04592484152f442122fb6f86b271","source_id":"us-ky","stale":false,"prev":"us-ky/krs-204.210","next":"us-ky/krs-205.020"},"notice":"GroundRules: Original legal text.
