{"data":{"id":"us-ky/krs-205.193","jurisdiction":"us-ky","citation":"KRS 205.193","heading":"Cabinet to establish and maintain policies and practices -- Restrictions on","body":"recipient's use of cash assistance benefits -- Penalties -- Duties of cabinet.\n(1) The cabinet shall establish and maintain policies and practices necessary to ensure\ncompliance with 42 U.S.C. sec. 608(a)(12).\n(2) If a cash recipient of public assistance benefits uses an automated teller machine or\nany other means or device to withdraw cash using an electronic benefit transfer card\nissued by the cabinet, that cash may only be used for goods and services necessary\nfor the welfare of the family, including but not limited to food, clothing, housing,\nutilities, child care, transportation, medicine, and medical supplies.\n(3) If in the normal course of operations, the cabinet  finds that an individual has\nviolated subsection (2) of this section, the cabinet:\n(a) Shall through any means practical and to the extent permitted under state and\nfederal law, including but not limited to garnishment of future cash assistance\nbenefits, seek recoupment from the individual of any funds used in violation\nof subsection (2) of this section; and\n(b) May:\n1. Impose a fine on the individual in an amount not to exceed five hundred\ndollars ($500);\n2. Upon the first violation, disqualify the indivi dual from receiving public\nassistance benefits by means of a direct cash payment or an electronic\nbenefits transfer card for not more than one (1) month;\n3. Upon the second violation, disqualify the individual from receiving\npublic assistance benefits by m eans of a direct cash payment or an\nelectronic benefits transfer card for not more than three (3) months; and\n4. Upon the third violation, disqualify the individual from receiving public\nassistance benefits by means of a direct cash payment or an electroni c\nbenefits transfer card for not more than one (1) year.\n(4) The cabinet shall:\n(a) Through any means practical, inform all applicants for, and cash recipients of,\npublic assistance benefits of the restrictions and sanctions contained in this\nsection;\n(b) Investigate cases in which it believes cash benefits may be being used in\nviolation of subsection (2) of this section; and\n(c) Within ninety (90) days after July 14, 2022, promulgate administrative\nregulations in accordance with KRS Chapter 13A necessary to administer this\nsection.","path":["KRS Chapter 205"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53077","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:02Z","sha256":"fa798cd42255e10c8243dd60e99feedb1a267fa9c5db17df9bb8ee4672a1351f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-205.191","next":"us-ky/krs-205.200"},"notice":"GroundRules: Original legal text.
