{"data":{"id":"us-ky/krs-205.210","jurisdiction":"us-ky","citation":"KRS 205.210","heading":"Amount of assistance -- Proration in case of deficiency -- Resources","body":"defined.\n(1) The amount of public assistance to be granted shall be determined with due regard\nto the needs and resources of the individual and family as prescribed by regulation,\nprovided, that if available funds during a budgetary period are insufficient to meet\nthe full needs of the recipients in all or any of the categories of public assistance, the\nfunds available shall be reasonably prorated to recipients in such categories\naccording to pending and anticipated applications during such budgetary period.\n(2) Notwithstanding any other provisions of law to the contrary, resources in any given\ncase shall be deemed to include among other things:\n(a) The income and any property belong ing to any applicant or recipient; except\nthe exemptions of the kind and the amount of income prescribed by\nregulations within the scope of the public assistance titles of the Social\nSecurity Act, its amendments and other federal acts and regulations;\n(b) The income and any property of the spouse living with any needy aged, needy\nblind or needy permanently and totally disabled person; and\n(c) Such income and resources as may be available to applicants or recipients\nfrom persons legally liable for their support.\nThe price brought on the sale of property at a public auction conducted by a licensed\nauctioneer shall be deemed to be the fair market value of that property.\n(3) The value of any property voluntarily transferred by any applicant or recipient or the\nspouse living with any applicant or recipient for the purpose of establishing\neligibility for public assistance shall be deemed a resource of such applicant or\nrecipient under this section.","path":["KRS Chapter 205"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=45259","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:02Z","sha256":"6cab4872de9e1167b743cdda8ee46a3e325543e63e5646764cc2ed6aa66b02a1","source_id":"us-ky","stale":false,"prev":"us-ky/krs-205.204","next":"us-ky/krs-205.211"},"notice":"GroundRules: Original legal text.
