{"data":{"id":"us-ky/krs-205.211","jurisdiction":"us-ky","citation":"KRS 205.211","heading":"Secretary to correct any underpayment or overpayment of public","body":"assistance benefits.\n(1) Except as otherwise provided by law, the secretary may, in accordance with the\nregulations he may prescribe and to the extent permitted by federal law, take all\nnecessary steps to correct any underpayment or overpayment of public assistance\nbenefits under this chapter.\n(2) Recovery of overpayments by the secretary may be accomplished through\nrepayment, reduction of future public assistance benefits, or by civil acti on in the\nCircuit or District Court depending upon the jurisdictional amount involved.\n(3) No reduction in future benefits or civil action shall be instituted except after notice\nand an opportunity for a fair hearing have been given and the administrative and\njudicial remedies provided by this chapter have been either exhausted or abandoned.\n(4) For purposes of this section, overpayment shall include payments made to or in\nbehalf of an eligible person in excess of the amount of public assistance benefits to\nwhich they are entitled as defined by regulation, payments made to ineligible\npersons and payments made to persons pending a fair hearing decision or court\ndecision.\n(5) Nothing in this section shall be construed to prohibit criminal prosecution for fraud\nunder any other statute.","path":["KRS Chapter 205"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=7658","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:02Z","sha256":"eeef791ceb42dadcca8e3a17ebe1289b177db645498c56c393ce8d6baa8de98c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-205.210","next":"us-ky/krs-205.213"},"notice":"GroundRules: Original legal text.
