{"data":{"id":"us-ky/krs-205.520","jurisdiction":"us-ky","citation":"KRS 205.520","heading":"Title and purpose of KRS 205.510 to 205.630 -- Recovery from third","body":"parties for services rendered.\n(1) KRS 205.510 to 205.630 shall be known as the \"Medical Assistance Act.\"\n(2) The General Assembly of the Commonwealth of Kentucky recognizes and  declares\nthat it is an essential function, duty, and responsibility of the state government to\nprovide medical care to its indigent citizenry; and it is the purpose of KRS 205.510\nto 205.630 to provide such care.\n(3) Further, it is the policy of the Commo nwealth to take advantage of federal funds\nthat may be available for medical assistance. To qualify for federal funds the\nsecretary for health and family services may, except as provided in KRS 205.5372,\nby regulation comply with any requirement that may be imposed or opportunity that\nmay be presented by federal law. Nothing in KRS 205.510 to 205.630 is intended to\nlimit the secretary's power in this respect.\n(4) It is the intention of the General Assembly to comply with the provisions of Title\nXIX of the Social Security Act which require that the Kentucky Medical Assistance\nProgram recover from third parties which have a legal liability to pay for care and\nservices paid by the Kentucky Medical Assistance Program.\n(5) The Kentucky Medical Assistance Program shall be the payor of last resort and its\nright to recover under KRS 205.622 to 205.630 shall be superior to any right of\nreimbursement, subrogation, or indemnity of any liable third party.","path":["KRS Chapter 205"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55965","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:03Z","sha256":"3d623f36920c8d7a2bfd81f1f25b8b9be87effa2f93cae9f6c327154e322047a","source_id":"us-ky","stale":false,"prev":"us-ky/krs-205.518","next":"us-ky/krs-205.522"},"notice":"GroundRules: Original legal text.
