{"data":{"id":"us-ky/krs-205.527","jurisdiction":"us-ky","citation":"KRS 205.527","heading":"Managing of IMPACT Plus program by Medicaid managed care","body":"organization -- Continuation of services for eligible children -- Billing -- Gaps\nin service and lack of access.\n(1) As used in this section, \"IMPACT Plus\" program means the program of\ncommunity-based behavioral health services provided to an eligible IMPACT Plus\nrecipient through an agreement between the Department for Medicaid Services and\nthe Department for Public Health as the state agency for the federal Title V\nMaternal and Child Health Block Grant, 42 U.S.C. secs. 701 to 710 or as authorized\nunder subsection (3) of this section.\n(2) Any Medicaid managed care organization that contracts with the Department for\nMedicaid Services shall, to the extent possible under the Title V agreement, manage\naspects of the IMPACT Plus program for its members, including but not limited to\nthe determination of a child's eligibility for IMPACT Plus services, processing and\ndirect payment of claims, and audits. No state agency shall duplicate any function\nperformed by the Medicaid managed care organizations for the IMPACT Plus\nprogram. Appeals of payments shall be submitted for review to the Department for\nBehavioral Health, Developmental and Intellectual Disabilities.\n(3) Children eligible for the IMPACT Plus program may continue to receive services, if\nthe family and provider agree, from:\n(a) An individual IMPACT Plus therapist if the child is relocated outside of the\nprovider's service area; and\n(b) The same provider if a child is eligible for those services,  but no longer\neligible for IMPACT Plus services, and the provider meets the participation\nstandards to provide services under the acquired brain injury, the Michelle P.\nwaiver, the supports for community living, or the home and community based\nwaiver programs.\n(4) IMPACT Plus providers shall bill for all IMPACT Plus services, including case\nmanagement, under their IMPACT Plus provider identification. IMPACT Plus\nproviders shall not be required to obtain a Medical Assistance Identification\nNumber (MAID). Nothing in this section shall preclude an IMPACT Plus provider\nfrom applying for a MAID number, providing they meet all necessary criteria.\n(5) Medicaid managed care organizations may report documented gaps in IMPACT\nPlus services or lack of access to IMPACT  Plus services to the Department for\nBehavioral Health, Developmental and Intellectual Disabilities. The Department for\nBehavioral Health, Developmental and Intellectual Disabilities shall verify or not\nverify the reported gaps.\n(6) If the Department for B ehavioral Health, Developmental and Intellectual\nDisabilities verifies gaps in IMPACT Plus services or lack of access to IMPACT\nPlus services, IMPACT Plus providers may be utilized for additional IMPACT Plus\nservices and additional IMPACT Plus providers may be utilized.","path":["KRS Chapter 205"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=42419","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:03Z","sha256":"3adaa64b4a03e63b29759f72373df1f2987d429a2d70b6303b5e54a18671f688","source_id":"us-ky","stale":false,"prev":"us-ky/krs-205.526","next":"us-ky/krs-205.528"},"notice":"GroundRules: Original legal text.
