{"data":{"id":"us-ky/krs-205.5357","jurisdiction":"us-ky","citation":"KRS 205.5357","heading":"Medicaid managed care organization compliance fund.","body":"(1) (a) There is hereby established in the State Treasury a restricted fund to be known\nas the Medicaid managed care organization compliance fund.\n(b) The fund shall consist of all penalties or fines imposed by the cabinet on a\nmanaged care organization for violations of KRS 205.5356, any other contract\nviolation, or any violation of state or federal law related to the Medicaid\nprogram, regardless of the manner in which the penalty or fine is paid by a\nmanaged care organization, including but not limited to reducti ons in future\ncapitation payments or any monies withheld by the Department for Medicaid\nServices for payment of penalties or fines.\n(c) The fund shall be administered by the cabinet.\n(d) Notwithstanding KRS 45.229, fund amounts not appropriated at the clos e of a\nfiscal year shall not lapse but shall be carried forward into the next fiscal year.\n(e) Any interest earnings of the fund shall become a part of the fund and shall not\nlapse.\n(f) Notwithstanding KRS 48.630, expenditures shall not be made from this f und\nunless expressly appropriated by the General Assembly.\n(g) It is the intent of the General Assembly that monies in the fund shall provide\nfinancial support for future Medicaid reimbursement rate increases upon\nappropriation by the General Assembly.\n(2) The cabinet shall submit specific recommendations for the use of monies in the\nMedicaid managed care organization compliance fund to increase certain Medicaid\nreimbursement rates to the Legislative Research Commission for referral to the\nInterim Joint Committees on Appropriations and Revenue and Health Services and\nthe Medicaid Oversight and Advisory Board established in KRS 7A.273 by\nNovember 1, 2027, and November 1 of each following odd-numbered year.","path":["KRS Chapter 205"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57031","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:03Z","sha256":"a5a7ba7fa629273bcb30808a7f2062322f04eda0f76fed719472aa4fa73cacba","source_id":"us-ky","stale":false,"prev":"us-ky/krs-205.5356","next":"us-ky/krs-205.536"},"notice":"GroundRules: Original legal text.
