{"data":{"id":"us-ky/krs-205.5373","jurisdiction":"us-ky","citation":"KRS 205.5373","heading":"Department's duties when limited in ability to disenroll individuals from","body":"state medical assistance program.\n(1) When the Department for Medicaid Services receives federal funding for the state's\nmedical assistance program which is contingent on temporary maintenance of effort\nrestrictions, such as those restrictions imposed under Pub. L. No. 116 -127 sec.\n6008, or is for any reason limited in its ability to disenroll individuals from the\nstate's medical assistance program, the department shall:\n(a) Continue to conduct eligibility redeterminations as in the normal course of\nbusiness; and\n(b) Act on those redeterminations to the fullest extent permitted under federal\nlaw.\n(2) Following the expiration of any federally imposed restrictions describe d in\nsubsection (1) of this section, the department shall conduct a full audit in which the\ndepartment shall:\n(a) Within sixty (60) days, request approval from the federal Centers for Medicare\nand Medicaid Services to conduct and act on eligibility redeter minations for\neach individual who was enrolled during the period of federally imposed\nrestrictions and has been enrolled for more than three (3) months; and\n(b) Within twelve (12) months:\n1. Complete and act on eligibility redeterminations for all cases th at have\nnot had a redetermination within the previous twelve (12) months; and\n2. Complete and act on eligibility redeterminations for individuals\ndescribed in paragraph (a) of this subsection, if the department receives\nthe federal approval requested pursu ant to this paragraph (a) of this\nsubsection.","path":["KRS Chapter 205"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53082","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:03Z","sha256":"7e09e56647d76e764c7ec8f61642f3d924ee7bbb9cd3d8de317ca4a6170b4610","source_id":"us-ky","stale":false,"prev":"us-ky/krs-205.5372","next":"us-ky/krs-205.5374"},"notice":"GroundRules: Original legal text.
