{"data":{"id":"us-ky/krs-205.553","jurisdiction":"us-ky","citation":"KRS 205.553","heading":"Kentucky Medicaid pharmaceutical rebate fund.","body":"(1) There is hereby established within the Cabinet for Health and Family Services a\nrestricted fund to be known as the Kentucky Medicaid pharmaceutical rebate fund.\nAll moneys received by the Cabinet for Health and Family Services or the\nDepartment for Medicai d Services as compensation or rebate, including\nsupplemental rebates, from a pharmaceutical drug manufacturer, the state pharmacy\nbenefit manager contracted by the department pursuant to KRS 205.5512, or any\nother third -party entity contracted to administe r or assist in administering any\naspect of the Medicaid program, minus any remittance that may be owed to the\nfederal government, shall be deposited into the fund.\n(2) Moneys deposited into the fund shall be expended by the Department for Medicaid\nServices in accordance with federal law.\n(3) Notwithstanding KRS 45.229, moneys in the Kentucky Medicaid pharmaceutical\nrebate fund at the close of state fiscal year 2024 -2025 and state fiscal year 2025 -\n2026 shall not lapse but shall be carried forward into the next fiscal year.","path":["KRS Chapter 205"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55967","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:03Z","sha256":"fc030e83cb81720f5ad5d0abef1ac3cf30d1cd6f031d795e6266288e092a800e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-205.5520","next":"us-ky/krs-205.556"},"notice":"GroundRules: Original legal text.
