{"data":{"id":"us-ky/krs-205.557","jurisdiction":"us-ky","citation":"KRS 205.557","heading":"Medicaid  reimbursement  for advocacy  center's child medical","body":"evaluation -- Waivers -- Administrative regulations.\n(1) For the purposes of this section:\n(a) \"Advanced practice registered nurse\" has the same meaning as in KRS\n314.011;\n(b) \"Children's advocacy center\" has the same meaning as in KRS 620.020;\n(c) \"Child medical evaluation\" means  an  examination at a  children's\nadvocacy center to evaluate for child physical abuse, sexual abuse, or\nneglect and to exclude other etiologies and evaluate the health and\nwell-being of the child. A child medical evaluation shall include but not be\nlimited to one (1) or more of the following:\n1. A medical history taken from the child and a nonimplicated parent,\nguardian, or primary caretaker;\n2. A comprehensive physical examination;\n3. Laboratory services;\n4. Photo documentation;\n5. Follow-up evaluation; or\n6. A  mental health screening to determine the impact of the alleged\nabuse  on the mental health status of the child and the need for\nmental health services;\n(d) \"Physician\" has the same meaning as in KRS 311.550; and\n(e) \"Sexual assault nurse examiner\" has the same  meaning  as in KRS\n314.011.\n(2) The  Cabinet for Health and  Family Services and  any  managed  care\norganization or other entity with whom  the Department for Medicaid Services\ncontracts for the delivery of Medicaid services shall provide Medicaid\nreimbursement for a child medical evaluation provided by a licensed physician,\nadvanced  practice registered nurse, or sexual assault nurse examiner\nemployed  or contracted by a children's advocacy center if the children's\nadvocacy center is in compliance with the appropriate and necessary federal\nand state laws or regulations.\n(3) Child medical evaluations provided by a licensed physician, advanced practice\nregistered nurse, or sexual assault nurse examiner in a children's advocacy\ncenter shall be reimbursed by the Department for Medicaid Services at the true\nand actual cost of the child medical evaluation.\n(4) The  Department for Medicaid Services shall apply for any waivers of federal\nlaws or regulations necessary to implement this section.\n(5) The  cabinet shall promulgate administrative regulations in accordance with\nKRS  Chapter 13A to implement this section.","path":["KRS Chapter 205"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52103","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:03Z","sha256":"d0ee9468acef994ec7d9302d9a9dacb738fbc47af9d600209273ea36cb9108d2","source_id":"us-ky","stale":false,"prev":"us-ky/krs-205.556","next":"us-ky/krs-205.558"},"notice":"GroundRules: Original legal text.
