{"data":{"id":"us-ky/krs-205.558","jurisdiction":"us-ky","citation":"KRS 205.558","heading":"Prescreening and admissions review system.","body":"(1) To prevent inappropriate placement and to contain costs related thereto, the\nsecretary for health and family services shall implement a statewide prescreening\nand admissions review system, including the imposition of a resource means test,\nfor all long -term-care facilities and beds, as defined under KRS Chapter 216, and\nany acute-care hospital-based skilled-nursing or intermediate-care beds participating\nunder Title XIX of the Social Security Act, regardless of the payment status of the\nresident upon admission. Any person having resources sufficient to cover the cost of\ncare for at least three hundred sixty -five (365) days following admission may be\nadmitted to a long -term care bed or facility if such person so desires; provided,\nhowever, that if a person:\n(a) Is admitted to a long -term-care facility or acute -care hospital -based skilled -\nnursing or intermediate-care bed without participating in the prescreening and\nadmissions review system; or\n(b) Participates in the prescreening and admissions review system a nd is not\nauthorized for placement in a long -term-care facility or acute -care hospital -\nbased skilled-nursing or intermediate-care bed;\nsuch person is not eligible for medical assistance payment for skilled -nursing or\nintermediate-care for one (1) year aft er the date of the person's admission to a\nskilled-nursing or intermediate -care facility or acute -care hospital -based skilled -\nnursing or intermediate -care bed unless the person subsequently participates in the\nprescreening and admissions review system and is authorized for admission to an\nintermediate-care or skilled -nursing facility or acute -care hospital -based skilled -\nnursing or intermediate-care bed.\n(2) To implement the provisions of this section the cabinet shall establish preadmission\nscreening teams composed of a nurse, social worker, and physician.\n(3) Before preauthorization of any person for admission to an intermediate -care facility\nor skilled-care facility or acute -care hospital-based skilled-nursing or intermediate-\ncare bed, the cabinet shall first make the following determinations:\n(a) The health status and care needs of the person require immediate\ninstitutionalization in an intermediate -care facility or skilled -nursing facility\nor acute-care hospital-based skilled-nursing or intermediate-care bed;\n(b) The person and his family have been fully advised of alternatives to\ninstitutional care and possible sources of reimbursement for such care;\n(c) Alternatives to institutional care are not feasible; and\n(d) Other such determinations as specified by  administrative regulations\npromulgated by the cabinet under KRS Chapter 13A.\n(4) Admission of a person to an intermediate -care facility, or a skilled -nursing facility\nwithout first obtaining prior authorization from the Cabinet for Health and Family\nServices shall constitute a Class B violation.\n(5) The secretary for the cabinet shall promulgate such administrative regulations,\nsubject to KRS Chapter 13A, as necessary to implement this section.","path":["KRS Chapter 205"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=7706","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:03Z","sha256":"603ebc9bb4957f3b3d0ec077d29a60b08391a37e9208048cac84196325f48f4c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-205.557","next":"us-ky/krs-205.559"},"notice":"GroundRules: Original legal text.
