{"data":{"id":"us-ky/krs-205.5602","jurisdiction":"us-ky","citation":"KRS 205.5602","heading":"Definitions for this section and KRS 205.5601 and 205.5603 -- Duties of","body":"Department for Medicaid Services regarding ground ambulance service\ntransports -- Assessment amount and administration -- Need for state plan or\nwaiver amendment -- Reports.\n(1) For purposes of this section and KRS 205.5601 and 205.5603:\n(a) \"Ground ambulance provider\" means a ground ambulance provider licensed\nin accordance with administrative regulations promulgated by the Kentucky\nBoard of Emergency Medical Services;\n(b) \"Assessment\" means the Medicaid ambulance service provider assessment\nimposed in KRS 142.318;\n(c) \"Board\" means the Kentucky Board of Emergency Medical Services;\n(d) \"Commissioner\" means the commissioner of the Department for Medicaid\nServices; and\n(e) \"Department\" means the Department for Medicaid Services.\n(2) The department shall:\n(a) Promulgate administrative regulations to establish the standards and\nprocedures necessary to implement the provisions of this section and KRS\n205.5601 and 205.5603;\n(b) Calculate an assessment on emergency ground transport collections pursuant\nto subsection (3) of this section;\n(c) Administer assessment proceeds according to subsection (6) of this section;\n(d) Apply uniformly to all assessed ground ambulance providers any annual\nchanges to the assessment rate according to the process described in\nsubsection (3) of this section; and\n(e) Evaluate current ground ambulance provider reimbursement rates paid by\nmanaged care organizations and require increases consistent with:\n1. KRS 205.5601 and this section;\n2. Current fee-for-service reimbursement rates; and\n3. An adequate network of ambulance service providers.\n(3) (a) The assessment due from a ground ambulance prov ider on emergency ground\ntransport collections shall be not less than one -half of one percent (0.5%)\nlower than the maximum limit for a provider assessment as approved by the\nCenters for Medicare and Medicaid Services.\n(b) For illustrative purposes only, if the maximum limit for a provider assessment\nas approved by the Centers for Medicare and Medicaid Services is six percent\n(6%) of the emergency revenues collected by the ground ambulance provider,\nthe minimum taxable limit under this section would be five  and one -half\npercent (5.5%) of the emergency revenues collected.\n(4) The assessment shall not generate more than the maximum amount as approved by\nthe Centers for Medicare and Medicaid Services.\n(5) (a) 1. Within ninety (90) days after July 15, 2020, the commissioner shall\ndetermine whether a state plan amendment or an amendment to any\nKentucky federal Medicaid waiver is required to implement this section.\n2. If the commissioner determines that a state plan amendment or an\namendment to a Kentucky federal waiver is necessary, the commissioner\nis authorized to seek any necessary state plan or waiver amendment, and\nthe assessment shall not take effect until the state plan or waiver\namendment is approved.\n(b) The assessment shall not be implemented until the fi rst day of the calendar\nquarter after the Department for Medicaid Services receives notice of federal\nmatching funds approval from the Centers for Medicare and Medicaid\nServices and has notified the Department of Revenue of that approval.\n(c) The commissio ner shall implement this section to the extent that it is not\ninconsistent with the state Medicaid plan or any Kentucky federal Medicaid\nwaivers.\n(d) Payments to ground ambulance providers shall begin within ninety (90) days\nof the later of the approval of federal matching funds, the state plan, or waiver\namendment. The first monthly assessment payment shall be due sixty (60)\ndays after the implementation of the enhanced fee schedule.\n(6) The assessment shall be administered as follows:\n(a) An annual amount  of two hundred thousand dollars ($200,000) shall be\nreturned to the department to offset the Medicaid administration expenses;\n(b) The remaining portion of the assessment shall:\n1. Be utilized to increase the rates paid by a managed care organization for\nemergency ambulance services up to the amount paid by the fee -for-\nservice Medicaid program for emergency ambulance services; or\n2. Be paid as supplemental payments to ground ambulance providers in a\nproportional amount according to the total Medicaid ambul ance\ntransports; and\n(c) If any funds are remaining after the department's duties have been completed\nunder paragraph (b) of this subsection, the remaining funds shall be utilized\nby the department to increase non-emergency medical transport rates.\n(7) Each ground ambulance provider shall report to the board, at the time and in the\nmanner required by the board, ground emergency revenue collected to accomplish\nthe purposes of this section and KRS 205.5603.\n(8) (a) No more than one hundred eighty (180) days a fter the end of each calendar\nyear, the board shall submit to the cabinet transport data for all ground\nambulance providers licensed in Kentucky.\n(b) The data required by paragraph (a) of this subsection shall, at a minimum,\ninclude the number of emergency  ground transports completed during the\nprevious calendar year and the emergency revenue collected.","path":["KRS Chapter 205"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54513","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:03Z","sha256":"5c2310bcdccc364069054f4df48d60ec3e3a544f02af1dff8f1da0aee4ed3bd1","source_id":"us-ky","stale":false,"prev":"us-ky/krs-205.5601","next":"us-ky/krs-205.5603"},"notice":"GroundRules: Original legal text.
