{"data":{"id":"us-ky/krs-205.5604","jurisdiction":"us-ky","citation":"KRS 205.5604","heading":"Department for Medicaid Services to submit Medicaid preprint to","body":"establish supplemental payment program for public ground ambulance\nproviders -- Administration of program -- Funding -- Eligibility.\n(1) As used in this section, \"public ground ambulance provider\" means a ground\nambulance provider licensed in accordance with administrative regulations\npromulgated by the Kentucky Board of Emergency Medical Services, which is\nowned or operated by a city, county, urban -county government, consolidate d local\ngovernment, charter county government, unified local government, or special\ndistrict, except for a local rescue squad district created under KRS Chapter 39F.\n(2) (a) The Department for Medicaid Services shall submit a Medicaid preprint with\na January 1, 2026, effective date to the Centers for Medicare and Medicaid\nServices seeking authorization to establish and administer a supplemental\npayment program to provide state -directed Medicaid managed care payments\nto eligible public ground ambulance providers.\n(b) If approved by the Centers for Medicare and Medicaid Services, the\ndepartment shall:\n1. Establish and administer the program to provide state -directed Medicaid\npayments to eligible public ground ambulance providers for services\nprovided under the managed care component of the Medicaid program;\n2. Operate the supplemental payment program described in this section\nseparately from the assessment and directed payment program\nestablished under KRS 142.318, 205.5601, 205.5602, and 205.5603;\n3. Utilize a cost report to determine the average cost per transport, which\nshall be used in the upper payment limit calculation for the Medicaid\nmanaged care-directed payments;\n4. Establish a cost -based payment methodology in accordance with the\nCenters for Medicare and Medicaid Services' rules and regulations; and\n5. Promulgate administrative regulations necessary to carry out this\nsection.\n(3) (a) The state match funds required for the supplemental payment program for\npublic ground ambulance providers shall:\n1. Be provided by public ground ambulance providers participating in the\nsupplemental payment program via intergovernmental transfers or\nsimilar government fund transfers; and\n2. Include a total of two hundred thousand dollars ($200,000) annually that\nshall be retained by the department to offset administrative expenses\nrelated to the supplemental payment program for public ground\nambulance provi ders. Each participating public ground ambulance\nprovider shall be responsible for a percentage of the administrative fee\nretained by the department under this subparagraph equal to the\npercentage of the total number of qualifying ambulance runs a\nparticipating public ground ambulance provider made during the\nprevious year.\n(b) Participating public ground ambulance providers shall identify and utilize a\nsource of funding for the intergovernmental fund transfers required by\nparagraph (a) of this subsection, which shall:\n1. Be separate from the assessment authorized under KRS 205.6406;\n2. Not be from the state general fund; and\n3. Comply with the requirements of the Centers for Medicare and\nMedicaid Services.\n(c) A continued local source of funding shall be id entified for the nonfederal\nshare, which shall:\n1. Be separate from the assessment authorized under KRS 142.318;\n2. Not be from the state general fund; and\n3. Comply with the requirements of the Centers for Medicare and\nMedicaid Services.\n(4) To be eligible to receive state-directed payments under this section, a public ground\nambulance provider shall:\n(a) Hold a valid Medicaid provider agreement;\n(b) Submit an annual cost report in accordance with administrative regulations\npromulgated by the department; and\n(c) Provide emergency medical transportation services to Medicaid beneficiaries.","path":["KRS Chapter 205"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56191","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:03Z","sha256":"0921095b4a8b56223eaa4f14c580744b6d8a96106dc6f616f5e0c81842154c1c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-205.5603","next":"us-ky/krs-205.5605"},"notice":"GroundRules: Original legal text.
