{"data":{"id":"us-ky/krs-205.5605","jurisdiction":"us-ky","citation":"KRS 205.5605","heading":"Definitions for KRS 205.5605 to 205.5607.","body":"As used in KRS 205.5605 to 205.5607, unless the context otherwise requires:\n(1) \"Budget allowance\" means the amount of money made available each month to a\nconsumer to purchase covered services and supports. The amount of money shall\nnot exceed the amount that would have been allocated in the traditional Medicaid\nprogram for nonresidential and nonmedical services for the consumer;\n(2) \"Consumer\" means a person who has chosen to participate in the program, has met\nthe enrollment requirements, has a person -centered plan, and has received an\napproved budget allowance;\n(3) \"Covered services and supports\" means those services and supports that are eligible\nfor reimbursement under the program and that are approved for the consumer\nfollowing a functional needs assessment and pursuant to a person-centered plan;\n(4) \"Fiscal intermediary\" means an entity that is approved by the cabinet to provide\nservice that helps the consumer manage his or her budget allowance, retains the\nfunds, processes any employment and tax info rmation, reviews records to ensure\ncorrectness, writes paychecks to providers, and delivers paychecks or electronically\ntransfers funds to the consumer for distribution to providers or caregivers;\n(5) \"Provider\" means:\n(a) A person or agency licensed or ot herwise permitted to render services eligible\nfor reimbursement under this program for whom the consumer is not the\nemployer of record; or\n(b) A consumer -employed caregiver that renders services eligible for\nreimbursement under this program for whom the co nsumer is the employer of\nrecord;\n(6) \"Representative\" means an uncompensated individual designated by the consumer\nto assist in managing the consumer's budget allowance and needed services; and\n(7) \"Service advisor\" means the person who provides technical  assistance to a\nconsumer in meeting responsibilities under KRS 205.5605 to 205.5607.","path":["KRS Chapter 205"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=7709","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:03Z","sha256":"158fea09d9c1879b44ce1fcc9c775b72b483cff0dd4e32adc3ad8233b2068d42","source_id":"us-ky","stale":false,"prev":"us-ky/krs-205.5604","next":"us-ky/krs-205.5606"},"notice":"GroundRules: Original legal text.
