{"data":{"id":"us-ky/krs-205.5622","jurisdiction":"us-ky","citation":"KRS 205.5622","heading":"Kentucky Pharmaceutical Assistance Program -- Contingency for","body":"establishment -- Purpose -- Eligibility -- Enrollment priority.\n(1) The Kentucky Pharmaceutical Assistance Program may be established, contingent\nupon approval from the Centers for Medicare and Medicaid Services.\n(2) If established, the program shall be administered by the department. The program\nshall coordinate prescription drug coverage with the prescription drug benefit under\nthe MMA. A person shall be eligible for drug benefits under t his program if the\nperson:\n(a) Is a resident who is:\n1. Sixty-five (65) years of age or older; or\n2. Disabled and receiving a Social Security benefit and is enrolled in the\nMedicare program;\n(b) Has a household income at or below one hundred fifty percent (150%) of the\nfederal poverty guidelines;\n(c) Meets the asset test;\n(d) Is not a member of a Medicare Advantage Plan that provides a prescription\ndrug benefit; and\n(e) Is not a member of a retirement plan that is receiving a benefit under the\nMMA.\n(3) (a) The department shall give initial enrollment priority to the Medicaid dual\neligible population. A second enrollment priority shall be offered to Medicare\neligible applicants who have annual household incomes up to one hundred\nfifty percent (150%) of the fe deral poverty guidelines and who meet the asset\ntest.\n(b) Enrollment for Medicaid dual eligible persons shall take effect no later than\nOctober 1, 2005. Medicaid dual eligible persons may be automatically\nenrolled into the program, except that they may cho ose to opt out of the\nprogram. The department shall determine the procedures for automatic\nenrollment into and election out of the program. Applicants meeting the\nqualifications set forth in KRS 205.5621 to 205.5625 may begin enrolling into\nthe program at a time and in a manner as determined by the department.\n(4) An individual or married couple meeting the eligibility requirement s in subsection\n(1) of this section and not Medicaid dual eligible may apply for enrollment in the\nprogram by submitting an application to the department that attests to the age,\nresidence, household income, and liquid assets of the individual or couple.","path":["KRS Chapter 205"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=7714","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:03Z","sha256":"332d359a0d748828768b21c62484ffc1d0e96be7a766cbd5adf7c5e8080fcdd5","source_id":"us-ky","stale":false,"prev":"us-ky/krs-205.5621","next":"us-ky/krs-205.5623"},"notice":"GroundRules: Original legal text.
