{"data":{"id":"us-ky/krs-205.5624","jurisdiction":"us-ky","citation":"KRS 205.5624","heading":"Payment of benefits -- Limitations -- Qualification for coverage.","body":"(1) Benefits provided under the program shall be limited to the amount of\nappropriations.\n(2) The program shall be the payor of last resort. The program shall cover costs for\nparticipants that are not covered by the Medicare Part D program.\n(3) Except for dual  eligibles during the transition period, during which they are being\nmoved from Medicaid to a Medicare Part D program, applicants who are qualified\nfor coverage of payments for prescription drugs under a public assistance program\nshall be ineligible for the program for so long as they are so qualified.\n(4) Applicants who are qualified for full coverage of payments for prescription drugs\nunder another plan of assistance or insurance shall be ineligible to receive benefits\nfrom the program for so long as they  are eligible to receive pharmacy benefits from\nthe other plan.\n(5) Applicants who are qualified for partial payments for prescription drugs under\nanother insurance plan shall be eligible for the program but may receive reduced\nassistance from the program.","path":["KRS Chapter 205"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=7716","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:03Z","sha256":"0ddca856f5702b6eaa52462b736ed2780dac3c3a2e4bf9b5b8c47b22b24138b2","source_id":"us-ky","stale":false,"prev":"us-ky/krs-205.5623","next":"us-ky/krs-205.5625"},"notice":"GroundRules: Original legal text.
