{"data":{"id":"us-ky/krs-205.5631","jurisdiction":"us-ky","citation":"KRS 205.5631","heading":"Definitions for KRS 205.5631 to 205.5639.","body":"(1) As used in KRS 205.5631 to 205.5639, \"commissioner\" means the commissioner of\nthe Department for Medicaid Services.\n(2) As used in KRS 205.5632, \"new drug\" means a drug that is approved for marketing\nby the Federal Food and Drug Administration under a product licensing application,\nnew drug application, or a supplement to a new drug application, and that is a new\nchemical or molecular entity, but shall not mean the following:\n(a) Drugs, classes of drugs, or medical uses identified in 42 U.S.C. sec. 1396r -\n8(d)(2), as amended;\n(b) Drugs that are considered to be less than effective by the Federal Food and\nDrug Administration or drugs that are considered to be identical, related, or\nsimilar to the less than effective drugs; and\n(c) Drugs that are excluded from coverage by the Kentucky Medicaid program\ndue to lack of compliance by the drug manufacturer with federal drug rebate\nrequirements.","path":["KRS Chapter 205"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=7718","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:03Z","sha256":"824caed7f75c34f52be5abaa306ea3544a80cc1ff8d5884cd172856945795d9b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-205.5625","next":"us-ky/krs-205.5632"},"notice":"GroundRules: Original legal text.
