{"data":{"id":"us-ky/krs-205.5632","jurisdiction":"us-ky","citation":"KRS 205.5632","heading":"Prior authorization requirements -- Administrative regulations.","body":"(1) Upon initial coverage by the Kentucky Medicaid program, a new drug shall be\nexempt from prior authorization unless:\n(a) There has been a review of the drug and recommendation regarding prior\nauthorization by the Pharmacy and Therapeutics Advisory Committee  as\nprovided under KRS 205.564 and a final determination regarding prior\nauthorization by the secretary of the Cabinet for Health and Family Services;\nor\n(b) The drug is in a specific class of drugs for which the Pharmacy and\nTherapeutics Advisory Committe e has recommended, and the secretary of\nhealth and family services has determined, that all new drugs shall require\nprior authorization upon initial availability, in which case the drug shall\nrequire prior authorization and shall be scheduled for review by  the Pharmacy\nand Therapeutics Advisory Committee within seventy-five (75) days.\n(2) The Cabinet for Health and Family Services shall promulgate an administrative\nregulation in accordance with KRS Chapter 13A that describes the process by\nwhich drugs under this section shall be determined to require prior authorization.","path":["KRS Chapter 205"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=7719","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:03Z","sha256":"e37ce7a5675b9f588061d6415490ad28350e543750818eec2ffb2a6915831068","source_id":"us-ky","stale":false,"prev":"us-ky/krs-205.5631","next":"us-ky/krs-205.5634"},"notice":"GroundRules: Original legal text.
