{"data":{"id":"us-ky/krs-205.590","jurisdiction":"us-ky","citation":"KRS 205.590","heading":"Technical advisory committees.","body":"(1) The following technical advisory committees shall be established for the purpose of\nacting in an advisory capacity to the Advisory Council for Medical Assistance with\nrespect to the administration of the medical assistance program and in performing\nthe function of peer review:\n(a) A Technical Advisory Committee on Physician Services consisting of five (5)\nphysicians appointed by the council of the Kentucky State Medical\nAssociation;\n(b) A Technical Advisory Committee on Hospital Care consisting of five (5)\nhospital administrators appointed by the board of trustees of the Kentucky\nHospital Association;\n(c) A Technical Advisory Committee on Dental Care consisting of five (5)\ndentists appointed by the Kentucky Dental Association;\n(d) A Technical Advisory Commit tee on Nursing Service consisting of five (5)\nnurses appointed by the board of directors of the Kentucky State Association\nof Registered Nurses;\n(e) A Technical Advisory Committee on Nursing Home Care consisting of six (6)\nmembers of which five (5) members  shall be appointed by the Kentucky\nAssociation of Health Care Facilities, and one (1) member shall be appointed\nby the Kentucky Association of Nonprofit Homes and Services for the Aging,\nInc.;\n(f) A Technical Advisory Committee on Optometric Care consisti ng of five (5)\nmembers appointed by the Kentucky Optometric Association;\n(g) A Technical Advisory Committee on Podiatric Care consisting of five (5)\npodiatrists appointed by the Kentucky Podiatry Association;\n(h) A Technical Advisory Committee on Primary C are consisting of five (5)\nprimary care providers, two (2) of whom shall represent licensed health\nmaintenance organizations, appointed by the Governor, until such time as an\nassociation of primary care providers is established, whereafter the association\nshall appoint the members;\n(i) A Technical Advisory Committee on Home Health Care consisting of five (5)\nmembers appointed by the board of directors of the Kentucky Home Health\nAssociation;\n(j) A Technical Advisory Committee on Consumer Rights and Client N eeds\nconsisting of seven (7) members, with one (1) member to be appointed by\neach of the following organizations: the American Association of Retired\nPersons Kentucky, the Family Resource Youth Services Coalition of\nKentucky, the Kentucky Association of Co mmunity Health Workers, the\nKentucky Legal Services Corporation, the Arc of Kentucky, the Department\nof Public Advocacy, and the National Association of Social Workers -\nKentucky Chapter;\n(k) A Technical Advisory Committee on Behavioral Health consisting of seven\n(7) members, with one (1) member to be appointed by each of the following\norganizations: the Kentucky Mental Health Coalition, the Kentucky\nAssociation of Regional Programs, the National Alliance on Mental Illness\n(NAMI) Kentucky, a statewide mental health consumer organization, the\nPeople Advocating Recovery (PAR), the Brain Injury Association of America-\nKentucky Chapter, and the Kentucky Brain Injury Alliance;\n(l) A Technical Advisory Committee on Children's Health consisting of ten (10)\nmembers, wi th one (1) member to be appointed by each of the following\norganizations: the Kentucky Chapter of the American Academy of Pediatrics,\nthe Kentucky PTA, the Kentucky Psychological Association, the Kentucky\nSchool Nurses Association, the Kentucky Association  for Early Childhood\nEducation, the Family Resource and Youth Services Coalition of Kentucky,\nthe Kentucky Youth Advocates, the Kentucky Association of Hospice and\nPalliative Care, a parent of a child enrolled in Medicaid or the Kentucky\nChildren's Health Insurance Program appointed by the Kentucky Head Start\nAssociation, and a pediatric dentist appointed by the Kentucky Dental\nAssociation;\n(m) A Technical Advisory Committee on Intellectual and Developmental\nDisabilities consisting of nine (9) members, one (1) of whom shall be a\nconsumer who participates in a nonresidential community Medicaid waiver\nprogram, one (1) of whom shall be a consumer who participates in a\nresidential community Medicaid waiver program, one (1) of whom shall be a\nconsumer representative of a family member who participates in a community\nMedicaid waiver program, and one (1) of whom shall be a consumer\nrepresentative of a family member who resides in an ICF/ID facility that\naccepts Medicaid payments, all of whom shall be appointed by th e Governor;\none (1) member shall be appointed by the Arc of Kentucky; one (1) member\nshall be appointed by the Commonwealth Council on Developmental\nDisabilities; one (1) member shall be appointed by the Kentucky Association\nof Homes and Services for the Aging; and two (2) members shall be appointed\nby the Kentucky Association of Private Providers, one (1) of whom shall be a\nnonprofit provider and one (1) of whom shall be a for-profit provider;\n(n) A Technical Advisory Commi ttee on Therapy Services consisting of six (6)\nmembers, two (2) of whom shall be occupational therapists and shall be\nappointed by the Kentucky Occupational Therapists Association, two (2) of\nwhom shall be physical therapists and shall be appointed by the Kentucky\nPhysical Therapy Association, and two (2) of whom shall be speech therapists\nand shall be appointed by the Kentucky Speech -Language-Hearing\nAssociation;\n(o) A Technical Advisory Committee on Pharmacy consisting of seven (7)\nmembers, two (2) of who m shall be Kentucky licensed pharmacists who own\nfewer than ten (10) pharmacies in the Commonwealth and shall be appointed\nby the Kentucky Independent Pharmacy Alliance, two (2) of whom shall be\nKentucky licensed pharmacists and shall be appointed by the K entucky\nPharmacy Association, and one (1) member to be appointed by each of the\nfollowing organizations: the Kentucky Hospital Association, the Kentucky\nPrimary Care Association, and the National Association of Chain Drug Stores;\n(p) A Technical Advisory Committee on Persons Returning to Society from\nIncarceration consisting of twelve (12) members of whom:\n1. One (1) shall be appointed by each of the following organizations: the\nKentucky Jailers Association, the Kentucky Medical Association, the\nKentucky A ssociation of Nurse Practitioners and Nurse -Midwives,\nCommunity Action of Kentucky, the Homeless and Housing Coalition\nof Kentucky, the Kentucky Office of Drug Control Policy, a Kentucky\ncivil legal aid program, the Kentucky Department of Corrections, the\nKentucky Department of Public Advocacy, the Kentucky Association of\nRegional Programs, and the Kentucky Administrative Office of the\nCourts; and\n2. One (1) formerly incarcerated individual who is a current or former\nMedicaid recipient shall be appointed by  Mental Health America of\nKentucky; and\n(q) A Technical Advisory Committee on Emergency Medical Services consisting\nof seven (7) members, one (1) of whom shall represent the air medical\nindustry and shall be appointed by the Kentucky Chapter of the Association of\nAir Medical Services; one (1) of whom shall be appointed by the Kentucky\nBoard of Emergency Medical Services; two (2) of whom shall represent the\nemergency medical services billing industry and shall be members of and\nappointed by the Kentucky Ambu lance Providers Association; two (2) of\nwhom shall represent ground ambulance providers and shall be appointed by\nthe Kentucky Ambulance Providers Association; and one (1) of whom shall\nrepresent a fire -based emergency medical service and shall be appointe d by\nthe Kentucky Association of Fire Chiefs. All members appointed to this\ncommittee shall represent emergency medical services providers that operate\nin Kentucky and shall have experience in interpreting, implementing, or\nensuring compliance with Medicaid regulations.\n(2) The members of the technical advisory committees shall serve until their successors\nare appointed and qualified.\n(3) Each appointive member of a committee shall serve without compensation but shall\nbe entitled to reimbursement for actual  and necessary expenses in carrying out their\nduties with reimbursement for expenses being made in accordance with state\nregulations relating to travel reimbursement.","path":["KRS Chapter 205"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52877","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:04Z","sha256":"281ec8e784b3bf86fbf45b77fe81a8b00cc7f673c6b4da1fe89f16c5d2325182","source_id":"us-ky","stale":false,"prev":"us-ky/krs-205.585","next":"us-ky/krs-205.591"},"notice":"GroundRules: Original legal text.
