{"data":{"id":"us-ky/krs-205.595","jurisdiction":"us-ky","citation":"KRS 205.595","heading":"Health coverage for child under medical child support order -- Duties of","body":"employers.\nIf a parent is required by a court or administrative order to provide health coverage for a\nchild and the parent is eligible for family health coverage through an empl oyer doing\nbusiness in the Commonwealth, the employer is required:\n(1) To permit the parent to enroll under family coverage any child who is otherwise\neligible for the coverage, without regard to any enrollment season restrictions;\n(2) In the case where th e noncustodial parent provides health care coverage and\nchanges employment, to accept a notice of transfer of the provision to enroll from\nthe Cabinet for Health and Family Services, the custodial parent or the noncustodial\nparent, and to enroll the child in the noncustodial parent's health care coverage,\nunless the noncustodial parent contests the notice pursuant to KRS Chapter 13B;\n(3) If a parent is enrolled but fails to make application to obtain coverage for the child,\nto enroll the child under family coverage upon application by the child's other\nparent, custodial parent, or by the Cabinet for Health and Family Services;\n(4) Not to disenroll or eliminate coverage of a child unless:\n(a) The employer is provided satisfactory written evidence that a court  or\nadministrative order requiring coverage of the child is no longer in effect, or\nthat the child is or will be enrolled in comparable health coverage which will\ntake effect no later than the effective date of the disenrollment; or\n(b) The employer has el iminated family health coverage for all of its employees;\nand\n(5) To withhold from the employee's compensation the employee's share, if any, of\npremiums for health coverage, except that the amount withheld may not exceed the\nmaximum amount permitted to be withheld under Section 303(b) of the Federal\nConsumer Credit Protection Act, and to pay the share of premiums to the insurer.","path":["KRS Chapter 205"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=7737","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:04Z","sha256":"46c13a068f58ae5c5a61119a4c46398575d558cc0e5a8173e3b361734b3acf51","source_id":"us-ky","stale":false,"prev":"us-ky/krs-205.594","next":"us-ky/krs-205.596"},"notice":"GroundRules: Original legal text.
