{"data":{"id":"us-ky/krs-205.617","jurisdiction":"us-ky","citation":"KRS 205.617","heading":"Expansion of Medicaid coverage for screening and treatment of breast or","body":"cervical cancer or precancerous conditions -- Short title.\n(1) The Department for Medicaid Services shall expand Medicaid coverage to offer\nbenefits to uninsured women who:\n(a) Are under age sixty-five (65);\n(b) Are not otherwise eligible for Medicaid;\n(c) Have been screened for breast or cervical cancer or precancerous conditions,\nor any combination of these conditions, through the Centers for Disease\nControl and Prevention's National Breast and Cervical Cancer Early Detection\nProgram or through the Department for Public Health's Women's Cancer\nScreening Program;\n(d) Are in need of treatment for breast or cervical cancer or precancerous\nconditions, or any combination of these condi tions, as a result of a diagnosis\nof those conditions in a program identified in paragraph (c) of this subsection;\n(e) Are not otherwise covered under creditable coverage, as defined in 42 U.S.C.\nsec. 300gg(c); and\n(f) Meet any other eligibility -required c riteria established under the Federal\nBreast and Cervical Cancer Prevention and Treatment Act of 2000.\n(2) No later than three (3) months after April 10, 2008, the department shall submit to\nthe secretary of the United States Department for Health and Huma n Services a\nrequest for approval of a plan amendment to extend coverage as authorized under\nsubsection (1) of this section.\n(3) Within three (3) months following receipt of federal approval of a plan amendment,\nthe department shall promulgate administrative regulations in accordance with KRS\nChapter 13A to implement the requirements of this section. If federal approval has\nnot been received within six (6) months after April 10, 2008, for the plan\namendment, the department shall report the status of the req uest for approval and\nthe steps being taken by the department to secure federal approval.\n(4) Medical assistance provided under the plan amendment shall be limited to medical\nassistance provided during the period in which a woman who meets the\nrequirements of subsection (1) of this section requires treatment for breast or\ncervical cancer or precancerous conditions, or any combination of these conditions.\nIn the case of any covered woman whose medical assistance has been terminated\ndue to a cure or remission  of a condition diagnosed under subsection (1)(c) of this\nsection, medical assistance shall be reinstituted for any subsequent periods of\nrecurrence or metastasis or any future conditions establishing eligibility under\nsubsection (1) of this section.\n(5) This section shall be known as the Kentucky Breast and Cervical Cancer Treatment\nAct of 2008.","path":["KRS Chapter 205"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=7745","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:04Z","sha256":"888263c0f4cd38467ab1e2d6e923d1f97b9ede9d1f5f5dad42a1660b8e7d9cc7","source_id":"us-ky","stale":false,"prev":"us-ky/krs-205.615","next":"us-ky/krs-205.618"},"notice":"GroundRules: Original legal text.
