{"data":{"id":"us-ky/krs-205.618","jurisdiction":"us-ky","citation":"KRS 205.618","heading":"Coverage for tobacco cessation medications and services.","body":"(1) Notwithstanding any provision of law to the contrary, the Department for Medicaid\nServices or a managed care organization contracted to provide Medicaid services\nshall, at a minimum, provide coverage for all United States Food and Drug\nAdministration-approved tobacco cessation medications, all forms of tobacco\ncessation services recommended by the United States Preventive Services Task\nForce, including but not limited to individual, group, and telephone counseling, and\nany combination thereof.\n(2) The follo wing conditions shall not be imposed on any tobacco cessation services\nprovided pursuant to this section:\n(a) Counseling requirements for medication;\n(b) Limits on the duration of services, including but not limited to annual or\nlifetime limits on the number of covered attempts to quit; or\n(c) Copayments or other out-of-pocket cost sharing, including deductibles, unless\notherwise required under federal law.\n(3) Utilization management requirements, including prior authorization and step\ntherapy, shall not be  imposed on any tobacco cessation services provided pursuant\nto this section, except in the following circumstances where prior authorization may\nbe required:\n(a) For a treatment that exceeds the duration recommended by the most recently\npublished United S tates Public Health Service clinical practice guidelines on\ntreating tobacco use and dependence; or\n(b) For services associated with more than two (2) attempts to quit within a\ntwelve (12) month period.\n(4) Nothing in this section shall be construed to pro hibit the Department for Medicaid\nServices or a managed care organization contracted to provide Medicaid services\nfrom providing coverage for tobacco cessation services in addition to those\nrecommended or to deny coverage for services that are not recommen ded by the\nUnited States Preventive Services Task Force.","path":["KRS Chapter 205"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57024","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:04Z","sha256":"1e1068ca9fb344d87b97f4eb68e3ed4e5bea2fcdd57ea8146ede3faf3402ca97","source_id":"us-ky","stale":false,"prev":"us-ky/krs-205.617","next":"us-ky/krs-205.619"},"notice":"GroundRules: Original legal text.
