{"data":{"id":"us-ky/krs-205.623","jurisdiction":"us-ky","citation":"KRS 205.623","heading":"Information on claims paid for insurance policyholders and dependents --","body":"Use of data -- Confidentiality of information -- Prohibited fees.\n(1) All health insurers and administrators as defined under KRS Chapter 304 shall\nprovide upon request to the De partment for Medicaid Services, by electronic means\nand in the format prescribed by the department, policy and coverage information\nand claims paid data on Medicaid -eligible policyholders and dependents. Any\nrequest from the department shall include a list  of data elements that shall be\nincluded on the electronic file from the insurer or administrator.\n(2) All health insurers and administrators as defined under KRS Chapter 304 shall\nprovide upon request to the department, by electronic means and in the form at\nprescribed by the department, identifying information on all policyholders and\ndependents to match with the Medicaid management information system to\ndetermine which policyholders and dependents also participate in the Kentucky\nMedical Assistance Progra m. The identifying information shall include the name,\naddress, date of birth, and Social Security number as these items appear in the\ncompanies' files and as the department may require.\n(3) No health insurer or administrator shall be required to provide i nformation under\nthis section if doing so would violate any provision of federal law.\n(4) All information obtained by the department pursuant to this section shall be\nconfidential and shall not be open for public inspection.\n(5) The department shall not be charged a fee by a third party for information requested\nunder this section, nor shall the department be charged a fee by a third party for the\nprocessing and adjudication of the department's claim for recovery, reclamation, or\nvalidation of eligibility.","path":["KRS Chapter 205"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=7750","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:04Z","sha256":"c90f395f550e7a05154778390b0a1f112a8792affab01d4a733b17cc8aee016d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-205.622","next":"us-ky/krs-205.624"},"notice":"GroundRules: Original legal text.
