{"data":{"id":"us-ky/krs-205.6312","jurisdiction":"us-ky","citation":"KRS 205.6312","heading":"Cost-sharing requirements.","body":"(1) The Department for Medicaid Services and each managed care organization\ncontracted by the department to provide Medicaid services pursuant to this chapter\nshall establish cost-sharing requirements for Medicaid enrollees in accordance with\nthis section.\n(2) Unless otherwise required under federal law, including 42 U.S.C. sec. 1396o(k),\ncost-sharing requirements established under this section shall only apply to\nMedicaid enrolled individuals:\n(a) With a family income that exceeds one hundred percent (100%) of  the federal\npoverty line; and\n(b) Who are enrolled in the Medicaid program under 42 U.S.C. sec.\n1396a(a)(10)(A)(i)(VIII).\n(3) In accordance with 42 U.S.C. sec. 1396o(k)(2)(B)(i), the following services shall\nnot be subject to cost -sharing requirements est ablished under this section unless\notherwise required by federal law:\n(a) Any care, item, or service described in 42 U.S.C. sec. 1396o(a)(2)(B) et seq.;\n(b) Primary care services;\n(c) Mental health care services;\n(d) Substance use disorder services;\n(e) Any services provided by a:\n1. Federally-qualified health center, as defined in 42 U.S.C. sec.\n1396d(l)(2);\n2. Certified community behav ioral health clinic, as defined in 42 U.S.C.\nsec. 1396d(jj)(2); or\n3. Rural health clinic, as defined in 42 U.S.C. sec. 1396d(l)(1); and\n(f) Any other service exempted from cost -sharing requirements under federal\nlaw.\n(4) (a) Except as provided in paragraph (b) of this subsection and subsections (3) and\n(5) of this section, beginning October 1, 2028, for care or an item or service\nfurnished to a Medicaid enrolled individual described in subsection (2) of this\nsection, the cost -sharing requirement establishe d under this subsection shall\nbe in the form of a copayment requirement equal to five dollars ($5).\n(b) The cost -sharing requirements established under this subsection for any\nprescription drugs shall be in the form of a copayment requirement equal to\none dollar ($1).\n(5) The total aggregate amount of cost sharing imposed under this section for all\nindividuals in a family shall not exceed five percent (5%) of the family's income on\na monthly or quarterly basis, as determined by the secretary.","path":["KRS Chapter 205"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57022","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:04Z","sha256":"adbf91052f39369483c6675184d59fdd5c58ffc93a1b8bc19b3c104a514edf2e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-205.6311","next":"us-ky/krs-205.6313"},"notice":"GroundRules: Original legal text.
