{"data":{"id":"us-ky/krs-205.6317","jurisdiction":"us-ky","citation":"KRS 205.6317","heading":"Department for Medicaid Services to develop strategies for reimbursing","body":"and paying persons participating in the Supports for Community Living\nWaiver Program -- Allocation of slots -- Administrative regulations -- Funding.\n(1) As used in this section:\n(a) \"Supports for Community Living Waiver Program\" means funding from the\nDepartment for Medicaid Services to serve individuals with an intellectual\ndisability or other developmental disabilities who qualify for intermediate care\nand choose to liv e in a community -based setting and includes funding for a\nself-determination model that provides the ability for the individual receiving\nservices and supports to personally control, with appropriate assistance, a\ntargeted amount of dollars; and\n(b) \"Slots\" means the dedication of provider or financial resources for services to\npersons with an intellectual disability or other developmental disabilities.\n(2) The Department for Medicaid Services shall develop and implement flexible\nreimbursement and payment strategies that reflect the individually determined needs\nfor services and supports by persons with an intellectual disability and other\ndevelopmental disabilities participating in the Supports for Community Living\nWaiver Program.\n(3) The Department for Med icaid Services shall allocate slots to the fourteen (14)\ncommunity mental health regions based on percentage of total population.\n(4) The Department for Medicaid Services shall reallocate underutilized slots to address\nstatewide needs and shall reallocate slots in emergency situations to address unmet\nneeds for services and supports.\n(5) The Department for Medicaid Services shall promulgate administrative regulations\nin accordance with KRS Chapter 13A to implement the requirements of this section.\n(6) Funds for the Supports for Community Living Waiver Program shall be\nappropriated only for direct services to qualified individuals and any unexpended\nfunds shall not lapse but shall be carried forward to the next fiscal year and shall be\nused for the same purpose.","path":["KRS Chapter 205"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=50043","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:04Z","sha256":"976d9c963a801b29f311d906f87aa2897212c3203b6ed5c6c214919493410fbd","source_id":"us-ky","stale":false,"prev":"us-ky/krs-205.6316","next":"us-ky/krs-205.63171"},"notice":"GroundRules: Original legal text.
