{"data":{"id":"us-ky/krs-205.632","jurisdiction":"us-ky","citation":"KRS 205.632","heading":"Pilot project to create coverage provisions and reimbursement criteria for","body":"telemonitoring services based on evidence -based best practices provided by a\nqualified medical provider or community action agency.\n(1) As used in this section:\n(a) \"Department\" means the Department for Medicaid Services;\n(b) \"Evidence-based best practices\" means the integration of the best available\nresearch with clinical expertise in the context of patient characteristics and\npatient and family caregiver preferences;\n(c) \"Qualified medical provider\" means a credentialed and enrolled Medicaid -\nparticipating healthcare provider, hospital, rural health center, or licensed\nhome health agency as defined in KRS 216.935; and\n(d) \"Telemonitoring services\" means services that require s cheduled remote\nmonitoring of data related to a patient's health where the monitoring is\nconducted at the patient's place of residence or other site determined by the\ndepartment.\n(2) Not later than July 1, 2017, the department shall establish a pilot proje ct in which it\ncreates coverage provisions and reimbursement criteria for telemonitoring services\nbased on evidence-based best practices provided by a qualified medical provider or\na community action agency as defined in KRS 273.410.\n(3) In order to effectuate the pilot project, the department may:\n(a) Submit a state plan amendment, waiver, or waiver amendment for approval to\nthe Centers for Medicare and Medicaid Services in order to provide coverage\nfor medically necessary telemonitoring services performed  for a Medicaid\nbeneficiary;\n(b) Request funding from the General Assembly to support telemonitoring\nservices rendered by a qualified medical provider or a community action\nagency under this section;\n(c) Ensure that clinical information gathered by a quali fied medical provider or a\ncommunity action agency while providing telemonitoring services is shared\nwith the patient's treating health care professionals; and\n(d) Promulgate administrative regulations in accordance with KRS Chapter 13A\nfor the implementation and administration of this section.","path":["KRS Chapter 205"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=45357","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:04Z","sha256":"cf635ee779a11b19c022ca4ec7d97abad1b7a65d9f7af85c9ae6c42ba6e9cbf5","source_id":"us-ky","stale":false,"prev":"us-ky/krs-205.6318","next":"us-ky/krs-205.6320"},"notice":"GroundRules: Original legal text.
