{"data":{"id":"us-ky/krs-205.6322","jurisdiction":"us-ky","citation":"KRS 205.6322","heading":"Cabinet to seek to prohibit sheltering of assets in long-term-care cases.","body":"The Cabinet for Health and Family Services shall seek to prohibit the sheltering of assets\nin medical assistance long-term-care cases by promulgation of administrative regulations,\npursuant to KRS Chapter 13A, that establish the following:\n(1) Consideration of assets placed in Medicaid -qualifying trusts as a prohibited transfer\nof resources, to the extent prohibited by federal law;\n(2) Revision of Medicaid policy to provide that assets funding the purchase of an\nannuity shall be treated as a transfer of res ources unless the annuity is actuarially\nsound as defined in administrative regulations promulgated by the cabinet pursuant\nto KRS Chapter 13A;\n(3) Revision of Medicaid policy to treat income -producing property as an available\nresource to the extent allowed by federal law;\n(4) Review of Medicaid eligibility procedures and operation to improve eligibility\nverification and detection of fraud and abuse; and\n(5) Review of the feasibility of instituting a photographic identification card, possibly\nin conjunction with other entitlement programs, to reduce fraud and abuse through\nmisuse of Medicaid identification cards.","path":["KRS Chapter 205"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=7766","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:04Z","sha256":"26397306012f54d0b23de12a35f64c306e7ea40948a510df7f10a4609c38d9f6","source_id":"us-ky","stale":false,"prev":"us-ky/krs-205.6320","next":"us-ky/krs-205.6324"},"notice":"GroundRules: Original legal text.
