{"data":{"id":"us-ky/krs-205.637","jurisdiction":"us-ky","citation":"KRS 205.637","heading":"Enhanced Medicaid payments to county -owned or operated hospitals --","body":"Payments to other hospitals.\n(1) (a) A county -owned or operated hospital shall receive an enhanced Medicaid\npayment in an amount, calculated from the most recent cost report filed by\nthat hospital with the department as of June 30 of each year, equal to the\ndifference between the amount of total payments made to the hospital by the\ndepartment or a managed care entity for covered services provided to\nMedicaid beneficiaries, including se rvices attributable to recipients in\nMedicaid managed care programs, during the state fiscal year and the\nhospital's cost for the services determined by the department under Medicare\npayment principles. Reimbursement under this section shall be made in a\nsingle payment. From July 1 through August 1 of each year, the Department\nfor Medicaid Services shall calculate the payment due to be made to each\ncounty-owned or operated hospital and shall make the payment to each\nhospital no later than August 15 of each state fiscal year. The department shall\nmake an enhanced payment to each county-owned or operated hospital in state\nfiscal year 1998 using cost reports filed with the department on or before June\n30, 1998, for the hospitals' latest fiscal year.\n(b) A payment described in this section is not due to a county -owned or operated\nhospital unless an intergovernmental transfer is made. A county -owned or\noperated hospital may make an intergovernmental transfer, or an\nintergovernmental transfer may be made on behalf of the hospital by a county,\nbudget unit of a county governmental agency, or lending institution if it is not\nprohibited by state or federal law.\n(c) An intergovernmental transfer shall be made to the enhanced Medicaid\npayment fund by August 2 of each stat e fiscal year in an amount equal to\neighty percent (80%) of the amount determined under paragraph (a) of this\nsubsection and shall be matched with federal funds.\n(d) An enhanced Medicaid payment shall be made to each county -owned or\noperated hospital participating in the intergovernmental transfer program in an\namount equal to one hundred percent (100%) of the hospital's Medicaid\nshortfall as determined under paragraph (a) of this subsection.\n(e) The department shall determine the Medicaid shortfall for all  other hospitals\nthat are not county -owned or operated or are not state -university-owned or\noperated hospitals, which shall be equal to the difference between total\npayments made by the department or a managed care entity for covered\nservices provided to M edicaid beneficiaries, including those enrolled in\nmanaged care, during the state fiscal year and the hospital's costs for the\nservices as determined by the department under Medicare payment principles.\nFunds remaining from the enhanced Medicaid program sh all be distributed to\neach hospital which is not county-owned or operated or is not state-university-\nowned or operated on a pro rata basis. If funds remain in the enhanced\nMedicaid payment fund after making enhanced Medicaid payments required\nby this subse ction, the remaining funds shall be available for use by the\ndepartment for funding the regular Medicaid program.\n(2) The enhanced Medicaid payment authorized under subsection (1) of this section\nshall not be implemented as part of the disproportionate share hospital program or if\nfederal financial participation is not available.\n(3) The Cabinet for Health and Family Services shall promulgate administrative\nregulations to implement the provisions of this section.","path":["KRS Chapter 205"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=7777","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:04Z","sha256":"725af530bd7faab437797f6e2ed670de9dc35cb46ed39eb36cca787ce10a98e8","source_id":"us-ky","stale":false,"prev":"us-ky/krs-205.636","next":"us-ky/krs-205.638"},"notice":"GroundRules: Original legal text.
